What the inspector wrote

On July 23, 2025, Licensing Program Analyst (LPA) Carol Heath conducted an announced Pre-Licensing capacity increase inspection. LPA met with licensee, Maria Cunial, who guided LPA on a tour of the home. The individuals residing in the home are the licensee and her spouse, both of whom have live-scan and TB skin test records on file, and their minor child (16). The licensee is requesting to operate as a small family childcare home. The days and hours of operation are Monday through Friday, 6:00 a.m. to 6:00 p.m. Incidental Medical Services (IMS) were discussed with the licensee. This is a two-story family home. The home features 4 bedrooms, 2.5 bathrooms, a kitchen, dining room, great room (also used as a childcare area), den (also used as a childcare area), laundry room, and garage. The primary care will be conducted in the den and great room. Children will have access to the great room, den, bathroom in the den, and side yard. The off-limit areas of the home include the entire upstairs area made inaccessible with a safety gate at the bottom of the stairs, the kitchen and dining room made inaccessible with safety gates, the garage with entry from the kitchen and inaccessible outside area on the right side of the home, and the pool area located directly in the backyard. The backyard is completely enclosed by a fiberglass fence. The accessible outside play area features a shed that is inaccessible due to a keypad lock. The children access the left side yard area through a door located to the left of the front entrance . LPA observed a dog in the left side yard, which is made inaccessible with a gate with a mesh lining. According to the licensee, the dog will be placed in the off-limits upstairs area prior to operating hours and transported outside during nap time, keeping it inaccessible to children. LPA obtained a declaration from licensee stating such. Bodies of water: LPA observed an in-ground pool in the backyard . The Mesh fences are constructed at least five (5) feet high. The bottom of the fence is no more than two (2) / four (4) inches from the soft ground /concrete. The fence does not obscure the pool from view. LPA observed the gates swing away from the pool, self-close, and have a self-latching device no more than six (6) inches from the top of the gate. LPA observed that the self-close and self-latching gate needs an adjustment. LPA observed an alarm on the sliding door leading from the kitchen to the outside area where the pool is located. LPA observed three windows leading directly to the pool area, each with an operating alarm to alert if the window is opened. LPA observed several age-appropriate toys and activities in the play area and in the side yard. LPA reminded licensee to provide 100% supervision. In addition, the following safety equipment was observed and visible from the swimming pool, readily accessible for immediate use: a life ring with a minimum exterior diameter of 17 inches, approved by the United States Coast Guard. A rescue pole equipped with a body hook, with a minimum fixed length of 12 feet. All licensed childcare centers and family care homes must inspect drowning prevention safety features and equipment daily before opening. During today\342\200\231s inspection, a pool safety log was observed next to the door. The licensee understands and agrees that the swimming pool fencing will remain in place whenever licensed care is provided, so long as the mesh fence makes the swimming pool inaccessible to children, as determined by licensing staff. No items around the perimeter of the fence would allow the fence to be climbable. An AC/Heating unit is located on the right side of the home and is inaccessible to children, as it is blocked by the gate. All unused electrical outlets are plugged in and inaccessible to children. The licensees enroll in the food program. They will provide breakfast, lunch, and snacks. A required fire extinguisher (2A10BC) was observed in the childcare area. It is read in the green zone, inaccessible to children, and meets standards established by the State Fire Marshal. All window blind cords are secured and inaccessible to children. If a child shows signs of illness, they will be separated from other children and stay in one of the childcare areas with an adult. Detergents and cleaning compounds are stored in an upper kitchen cabinet, out of reach with a safety latch. Medications are kept in an upper kitchen cabinet with a safety latch. Children will nap under adult supervision in designated areas, such as the family room. LPA observed 7 cots stored in the closet. The licensees do not provide overnight care. The household has 1 dog (kept in the off-limit backyard) which has current vaccinations and does not interact with children. The home has a working cell phone. All smoke detectors and carbon monoxide devices were tested and found to be operable. A fully stocked first aid kit, including a first aid manual, is stored in the child's bathroom and is kept out of reach of children. The licensees will provide transportation for the children in the future. They possess a valid California driver's license, vehicle insurance, and vehicle registration. Per the licensees, there are no firearms at the facility. LPA did not observe any firearms. Documentation: The licensees have current CPR and First Aid Training with expiration dates of 02/2026 and Prevented Health and Safety Training completed on 7/2023 . She has their fingerprint clearance and TB exam. She had proof of being immunized against influenza, pertussis, and measles. The licensees\342\200\231 proof of Mandatory Reporting Training expiration date is 6/2026 . LPA shared LIC 311D with the licensees. The following was discussed with the licensees: \302\267 [Licensee, Licensee, or Facility representative] was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. \302\267 LICENSEE OWNS OR RENTS/LEASES THE HOME: The [licensee, or licensee] provided proof of control of property. \302\267 LICENSEE RENTS/LEASES THE HOME AND HAS LANDLORD CONSENT: Because the [licensee, or licensee] rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the licensees confirms was provided to the property owner/landlord. The licensees obtained a signed Property Owner/Landlord Consent form (LIC 9149). \302\267 LICENSEE RENTS/LEASES THE HOME AND DOES NOT HAVE LANDLORD CONSENT: The [licensee, or licensee] has not obtained a signed Property Owner/Landlord Consent form (LIC9149). Without this consent, the licensees understands that, once licensed, they can operate with a maximum capacity of 6 [or 12] children. If property owner/landlord consent is obtained in the future, the licensees is advised that a new Application for a Family Child Care Home License (LIC 279) must be submitted with a change of capacity fee of $25, to increase the capacity and provide care to 8 [or 14] children. \302\267 LICENSEE KNOWS PROSPECTIVE CLIENTS WILL NEED IMS: This facility plans to provide Incidental Medical Services \342\200\223 IMS. For IMS information, see PIN 22-02-CCP . A Plan for Providing IMS must be submitted to the Department. Entrance Checklist was provided to the licensees. \302\267 On this date, xx/xx/xxxx, the California Attorney General - Megan\342\200\231s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. \302\267 LPA discussed the safe sleep regulations with [licensee, licensee, or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep , as an additional resource. State law prohibits baby walkers, bouncy seats, exersaucer, and other items that fall into that category. o Capacity requirements, Roster requirements, Posting requirements, and Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children's and provider's files and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. The licensees was reminded that supervision is always required for children in care. o The licensees was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B. o Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. The licensees was advised that the inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility's phone number; if the phone number is changed, licensing must be notified. o Requirements for fire drills, earthquake drills, and documentation for both. o The Duty Worker is available for questions Monday through Friday at (661) 202-3318 from 8:00 a.m. - 5:00 p.m. o The licensees is reminded that 100% supervision is required for children at all times. o The licensees was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hotline at 1-800-540-4000. Also, call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B). o The regulation prohibits the smoking of tobacco in private residences that is licensed as a family childcare home and in those areas of the family childcare home where children are present (24/7 ban). o Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.
