What the inspector wrote

Allegation #3- the interviews revealed there were four-day care children: C1, C2, C3, and C4 at the day care in the evening from 4:30-6:00 PM with one to two staff members. The staff provide care by combining infant children in the same areas with the preschool and school-aged children either strapping them in a multi- seated stroller in the lobby, putting them inside one classroom, or outside on the same play yard until the parents could pick up the children. Based on interviews, the infants under twenty-four months are being moved to the toddler and preschool room. Therefore, the allegation, Staff are co-mingling day care children in care, corroborates with the evidence. Based on interviews and record reviews the two allegations above are Substantiated, meaning the Preponderance of the evidence standard has been met. There is one Type A deficiency cited for Limitations on Capacity and one Type B deficiency for Reporting Requirements cited during this inspection. See LIC 809D pages attached to this report. Upon receipt of a Type A deficiency licensee shall post the report for 30 days in addition to the Notice of Site Visit and provide copies of the licensing report to parents/guardians of all children in care at the facility. This report must be provided to parents/guardians of children newly enrolled at the facility during the next 12 months. The representative will obtain a signed acknowledgment of Licensing Reports (LIC9224) from parent/guardians and place it in each of the children’s file (remain for three years) as there is an immediate risk to the health, safety, or personal rights of the persons in care. If these requirements are not met, civil penalties will be assessed. An exit interview was conducted, and a copy of this report was read, the Notice of Site Visit, and Appeal Rights, and this report were provided to Edna Hernandez, Facility Representative at the facility. A Notice of Site Visit must remain posted for 30 days. Removal of the posting is subject to a $100 civil penalty.

Based on interviews and record reviews the original, designated director never worked at the facility and the Licensee did not notify Licensing of the changes with the Director which is a potential health, safety, or personal rights risk to the persons in care.

    101161 (a) Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: Based on interviews, in the evening, the infant day care children are co-mingled with the preschool and school aged children. The children are strapped inside a multi-seated stroller in the lobby, or put in one classroom, or outside on the same play yard which is an immediate health, safety, or personal rights risks to the persons in care.
