What the inspector wrote

On 3/19/2024 Licensing Program Analysts(LPAs), Maddox and Ortega conducted a Case Management inspection to follow up on the required lead testing regulation PIN 21-21.1 CCP. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 , Health and Safety Code Section 1597.16 requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test. During inspection, facility submitted a waiver requesting to be exempt from lead testing due to facility being built in 2013. Although, facility was built in 2013, (documentation provided) facility does not utilize water for drinking nor food preparation. LPAs observed filtered water fountains and according to facility children bring their own individual water bottles and children may refill their water bottles as needed. LPAs Maddox and Ortega completed a walk through and observed 8 staff and 28 children present. LPAs also, observed five toddlers under the age of five years in the yellow room. According to facility they have the toddler component option. (Preschool Application indicates a toddler request). A review of records and children's records were conducted as part of this evaluation. According to records, the Fire clearance is currently pending with the Fire Department. LPAs informed facility a written parent/legal guardian consent shall be obtained and be accessible on file for every child participating in the toddler option. LPAs provided a copy of Title 22 regulation- 101216.4 Preschool Program with Toddler Component (a) Licensees serving preschool-age children may create a special program component for children who are between 18 months and 36 months of age . The provisions of Sections 101151 through 101239.2 shall apply for children over 24 months, i n addition to those specified in Health and Safety Code section 1596.955 . The provisions of Sections 101351 through 101439.1 shall apply for children between the ages of 18 and 24 months participating in a preschool toddler component, in addition to those specified in Health and Safety Code section 1596.955. (1) A child who is between 18 months and 36 months of age may participate in the toddler program with written permission from the child's authorized representative. No child in the toddler program shall be placed in the preschool program before the age of 30 months without written permission from the child's authorized representative. (2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department. No deficiencies cited at this time, a technical violation was provided and facility remains in compliance in accordance with the California Code of Regulations Title 22, Division 12. An exit interview was conducted, appeal rights discussed, and a copy of this , and the notice of site visit(NOA) was provided was provided t o Kaitlen Johnson, Director. Copy of this report must be made available to the public, at the facility site, for 3 years and the NOA posted for 30 days.
