What the inspector wrote

Based on LPA Rivera observations and interview, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22. One type A deficiency is being issued today for regulation 101429(a)(1)- (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. Under no circumstances shall ANY infant be left unattended. One tyoe B deficiency is being issued today for regulation 101161(a)- (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license. Please see attached LIC 809-D for citations. Upon receipt of this report, the licensee shall post any licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year. A copy of the Parent Notification Requirements was provided to the licensee, along with a copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with director Luis Ledesma. Director was provided a copy of the appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms. LPA observations and record review did not support nor confirm the above allegations. This agency has investigated the complaint alleging Staff did not ensure that the infant crib was free from all loose objects and Staff do not have the required education units or qualification At this time, it is determined that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated. No deficiency given at this time. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative.     Limitations on Capacity-(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license. This requirement is not met as evidenced by: Based on LPA Rivera observation, the facility did not comply with the section cited above in not having a school-age teacher for school-age component and child present in the preschool program which poses a potential health, safety or personal rights risk to persons in care.

    (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. Under no circumstances shall ANY infant be left unattended.This requirement is not met as evidenced by: Based on LPA Rivera observation infant sleeping in classroom and no staff present providing care and supervison which poses an immediate risk to the health and safety to the children in care.
