During the course of investigation LPA verified if her daughter was fingerprint cleared had required immunizations, a current CPR/1st Aid which expires 11/2025 and a current mandated reporter certificate. LPA found that the certificate had expired on 5/1/2024 and there was not a current training taken. A Case Management report for the mandated reporting was issued. On 7/12/2024 LPA Carolyn Tuba clarified California Code Title 22 section 102417(a) Operation of a Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. LPA provided a copy of the regulation to the Licensee. Based on the interview conducted the preponderance of evidence standard has not been met, therefore the above allegation is found to be substantiated. The following deficiency listed on the attached LIC 809 (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiency that are being cited need to be cleared to protect the children’s health & safety.
