What the inspector wrote

On 01/11/2023, at 1:30 PM, Licensing Program Analyst (LPA) Monique Ayala conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. LPA met with Education Supervisor, Yolanda Orozco who guided LPA on a tour of the facility. LPA observed 54 children in care. Facility was within ratio & capacity. A COVID 19 risk assessment was conducted prior to entering the facility. LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided facility sketch and required forms LIC 9276, LIC999 and LIC9275 to LPA on 01/11/2023. On 12/21/2022, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 09/27/2022, 10/06/2022 and 12/09/2022. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows: A \342\200\223 Classroom Sink (7.4 UG/L) \342\200\223 hand washing only, Room 28 B - Classroom Sink (15 UG/L) - Not in use, Room 29 C - Classroom Sink (6 UG/L) - Never used, Room 29 D- Classroom Sink (6.8 UG/L)- Hand washing only, Room 25 E - Classroom Sink (8 UG/L) - Hand washing only, Room 25 F - Drining Fountain (20 UG/L) - Never used G - Drinking Fountain (14 UG/L) - Never used Education Specialist stated that the facility has not used the the faucets in classroom 29 since June 2022 due to low enrollment. A work orders have placed to repair the sinks. Education Specialist stated that the 2 drinking fountains located outside have never been used for drinking. Education Specialist stated that the facility has always provided Sparkletts water for children to drink, and provided LPA with a copy of the contract dated back to 2003. The facility does not conduct any food preparation on site as the meals are prepared in the main kitchen at Bassett High School. Facility has put an "out of order/do not use" sign on and around the classroom faucet, and 2 drinking fountains and made it further inaccessible by attaching and secured a plastic bag around the outlet. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. An exit interview conducted and a copy of this report was provided to, Education Specialist, Yolanda Orozco along with Notice of Site Visit. A copy of PIN 21-21-CCP and appeal rights were provided to facility today.
