What the inspector wrote

On 01/20/2023, at 2:01 PM, Licensing Program Analyst (LPA) Cynthia Reyes conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. LPA met with facility Claudia Casillas, Program Facilitator during the inspection. Also present in the facility were 45 preschool children and 8 staff. Facility was within ratio & capacity. A COVID 19 risk assessment was conducted prior to entering the facility. LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with Program Facilitator during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. On 10/04/2022, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 10/04/2022. Faucet reported with 5.5 ppb or greater lead exceedance levels were as follows: \357\202\267 A \342\200\223 Drinking Fountain outside preschool (8.000 UG/L) Faucet currently not in use. Director stated that the drinking fountain has not been in use since before the Covid pandemic. Children normally carry their own drinking water bottles or they have jugs of water and disposable cups available. The faucet\342\200\231s have been locked since the start of the pandemic. In addition, no food preparation is conducted using that outdoor drinking faucet. The use of that faucet has been and was terminated when the facility was informed by the analyst that it was exceeding acceptable levels. Facility still has the drinking faucet locked as of this date even though it has been fixed and passed the second testing. See LIC 809C for continuation. The facility has fix the fixture and has utilized the new fixture flushing tracking sheet and documented the 30 second flush, 4 times each day for 3 weeks and has had the lead retested and passed with a compliance of 0.72 ppb on 01/20/2022. The facility provided a copy of the facility sketch and required forms LIC 9276, LIC999 and LIC9275 to LPA on this date 01/20/2023 as well as the compliance documents. LPA took picture of the drinking faucet on this date (Showing the lock tag). Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. A copy of PIN 21-21-CCP and appeal rights were provided to Claudia on this date. A notice of site visit was also provided and must remain posted for 30 days.
