What the inspector wrote
On 12/08/2025 Licensing Program Analysts (LPA) Mary Silva conducted an unannounced annual random inspection at the above facility. Inspection was conducted in Spanish. Licensing staff met with Licensee Amparo Bernales and Co-Licensee Victor Bernales to whom the reason for the inspection was explained. LPA was guided on a tour of the facility. There were no children present during this inspection. Facility capacity is in compliance for a Large Family Child Care Home. Per licensee four children are currently enrolled. Hours of operation are Monday-Friday 7:00 AM - 6:00 PM.
This is a single-story home which consists of 4 bedrooms, 2 bathrooms, kitchen, living room, dining room, family/ day care room, in ground swimming pool with Jacuzzi, front yard, fenced back yard and attached garage. Currently residing in the home are three adults (criminal record clearance on file) and no minor children. There was a total of 3 adults present during this inspection, licensee, co-licensee, and adult son.
Areas accessible to children were inspected as follows
: Family/daycare room, kitchen, dining room, living room, bathroom #1, bedroom#1 both located to the left of the hallway, and fenced back yard. Per licensee school age children use bedroom #1 to do homework. LPA observed a window in bedroom #1 overlooking the swimming pool and Jacuzzi, the window was observed to have a functioning alarm.

LPA observed the following required posted documentation in the main entry way of the facility: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA reviewed facility records for LIC 9040- Facility Roster(current), LIC 610- Facility Disaster Plan. LPA observed disaster drill conducted on 08/2025.
The home was observed to be clean and orderly, with central air and heating. Licensing staff observed the smoke detector and the carbon monoxide detector to be in operable condition. Licensing staff observed the valve on the required 2A 10BC fire extinguisher indicates fully charged with service receipt dated 11/10/2024. Reminded licensee fire extinguisher should be serviced yearly.
The home maintains telephone service via cell phone. There are toys and other age-appropriate material available for children. Licensee prepares breakfast, lunch, and snack for the children in care. Licensee provides transportation after school. The area between the dining room and kitchen is the designated area for isolation. LPA observed the daycare room had toys, puzzles and books for children. Napping equipment in form of mats were observed in the daycare room.
Licensee\342\200\231s stated that there are no poisons stored in the home and understands that all poisons must be locked, to be made inaccessible to children LPA observed kitchen knives and medicine were located above the refrigerator. Per Licensee there are no firearms or weapons stored in the home. Licensing staff reminded licensee smoking is not allowed in the home.
The Licensee\342\200\231s uses the left side of the back yard for outdoor play. The outdoor play area were observed to be fenced and separate from the pool area. Licensing staff observed that the outdoor yards have toys and other materials for children to play with.
LPA observed an in-ground swimming pool & Jacuzzi with a self- latching gate with a which opens away from the swimming pool with a combination lock on the top of the gate. The swimming pool has a black iron gate which is 5ft. The measurement from the hard concrete surface to the bottom of the fence is 2 inches, the openings between railings are 4.7 inches. LPA also observed iron mesh which surrounds the entire black iron fence making swimming pool.

LPA observed and tested the pool alarm brand model ASTMF2208, a life ring with an exterior diameter of 17 inches and labeled as approved by the United States Coast Guard, and a 12 ft rescue pool with a body hook on the left side as you enter the pool area. LPA reviewed the daily pool safety log has been maintained in a notebook. Licensee stated the combination lock on the wrought iron gate entering the pool will be replaced by a lockable device.
Child\342\200\231s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, and LIC 995A Notification of Parents\342\200\231 Rights.
Licensee file was reviewed for the following: LIC 508- Criminal Record Statement, Proof of immunizations against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse. Pediatric First Aid and CPR certification expires 04/19/2027 for licensee, and for co-licensee. Mandated Reporter Training has been completed and expires on 01/09/2027 for licensee, and co-licensee.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at

as an additional resource. Licensee currently does not have infants enrolled.
LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at

and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
MyChildCarePlan.org \342\200\223 Centers and Family Child Care Homes - Licensee, was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.
Megan\342\200\231s Law - Family Child Care Homes - During the exit interview, Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
Based on Licensing staff observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights was given.
