What the inspector wrote

On April 30, 2025, at 2:00 pm Licensing Program Analysts (LPA) Priscilla Ochoa conducted an unannounced case management inspection for the above facility. This facility is located on the premise of Palm Crest Elementary School. LPA was greeted by Site Director, Laura Navarette, who guided LPA on a tour of the facility. The purpose of this inspection is to follow up on a self-reported incident that occurred at the facility on 4/23/2025 . This is a school age program which operates Monday through Friday from 7:00 am to 6:00 pm. Per Site Director, there are 70 children enrolled and LPA observed 68 children in care along with 7 staff members. Brief summary of incident: Child #1 (C1) was climbing on a post on the play structure on the playground. While C1 was climbing down, C1 could not find C1 footing on the ladder causing C1 to slip and fall to the ground, landing on left shin. Due to the fall, C1 had a spiral break on left shin. During this inspection, LPA interviewed Staff #1 (S1), Staff #2 (S2), Child #1(C1) - Child #3 (C3). LPA also observed and took photos of the play structure on the playground and \342\200\234Play smart\342\200\235 rules for the play structure. During the course of interviews, S1 and S2 mentioned that C1 was climbing on the post all the way to the top which makes a V. C1 \342\200\223 C3 did mention that they are allowed to climb the post on the play structure. C3 mentioned that only 4 th and 6 th graders are allowed to climb the post. While LPA was observing the play structure and area that C1 had fallen from, the V section of the post is significantly high enough where a child can get severally injured if they fall. Please see the new report dated 8/20/25** Both S1 and S2 acknowledged that the V section of the post is significantly high to climb. LPA also observed and took a photo of the \342\200\234Play smart\342\200\235 rules that are posted next to the play structure. The post clearly states, \342\200\234Do not climb, roof, railings, or posts\342\200\246\342\200\235. Per S1, these rules are only gone over at the beginning of the school year. Per S2, they are constantly asking children not the climb the post. LPA asked if C1 was reminded not to climb the post and both S1 and S2 said no. S1 mentioned that it is their philosophy to allow children to use their fine and large motor skills. If they can climb it then they are do it. LPA reminded S1 its vital that the facility follows the rules of the play structure to ensure children are using it in a safe manner. Based on the LPA\342\200\231s interviews and observations, the following deficiency listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety. A notice of site visit was given and must remain posted for 30 days during facility\342\200\231s hours of operation. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
