What the inspector wrote

An announced Informal Office Meeting was conducted on this date with District Manager Esmeralda Camarena and Director Maricruz Flores at Kindercare Learning Center 10704 SCOTT AVE. Whittier, CA. 90604. In attendance was Licensing Program Analyst (LPA) Alanna Gontarek and Licensing Program Manager (LPM) Claudia Guangorena. Licensing Program Staff observed no children wearing face masks in two of the Preschool rooms. LPA Gontarek advised to have all children, above the age of 2, wearing masks for COVID-19 preventative measures. The purpose of the informal meeting was to discuss the following items: Lack of Supervision, Child's Personal Rights, Teacher-Child Ratio, and Reporting Requirements: 1. An unusual incident report received 09/10/2019 reporting 2 children ran out of classroom, and teacher waited till another teacher relieved her to retrieve the 2 children (lack of supervision). 2. Complaint received 8/13/19- cited a Type ‘B’ violation for 101226.3(a)- Observation of a child- Child sustained bruising around child's eye while in care and staff are not aware of how it happened. 3. Complaint received on 7/3/19- Type ‘A’ 101223.1- Personal Rights- facility failed to change child after child had a bowel movement. 4. Complaint received 7/3/19- Type ‘A’- 101216.3- Teacher-Child Ratio- facility was out of ratio. 5. Complaint received on 7/3/19- Type ‘A’ 101538.3- facility was commingling school-age children and pre-school children in the preschool classroom. 6. Complaint received 6/7/19- Type ‘A’ 101229(a)(1)- Responsibility for Providing Care & Supervision- Staff#1 did not have visual observation of the child 7. Complaint received 6/7/19- Type ‘B’ 101212(d)(1)(C)- facility reporting it to the department on 05/31/2019 when the incident happened on 05/17/2019 Page 1 of 2 8. On 5/31/2019, an Unusual Incident Report was submitted by Director untimely reporting a child ran away from a teacher and made it outside, not making it to parking lot. Incident needs clarification: Did child reach parking lot? Interview statements are different and change throughout interview process. 9. Case Management on 12/28/17- Type ‘A’ 101229(a)(1)- Care and Supervision- A child was left alone in the classroom for about 12 minutes while 3 staff members were unaware of the child missing. A civil penalty was assessed. 10. Case Management Deficiencies on 2/24/16- Type ‘B’ 101212(c)- Reporting Requirements- LPA observed carpet changes, asphalt redone, tree trimming and old turf removed and new turf installed in the toddler yard. These changes were not reported to the department. Licensing Program Staff advised Director and District Manager about the Technical Support Program (TSP) regarding compliance. Director will notify LPA Gontarek if interested in participating in TSP so referral can be made. A copy of Title 22 Regulations with regards to Reporting Requirements, Responsibility for Providing Care and Supervision, Teacher-Child Ratio and Personal Rights, along with a copy of the LIC624 Unusual Incident Report was explained and provided to Licensee and Director via email. The following was discussed with the Director and District Manager: 1. The licensee was advised that it is her responsibility to know & understand the requirements of Title 22 Regulations. 2. The licensee's facility must be in compliance at all times. 3. The licensee was advised to check the Child Care Licensing web site at www.ccld.ca.gov for quarterly updates, educational/training videos, forms and regulations. 4. Staff training will be conducted for Title 22: Proper Supervision, Child's Personal Rights, Teacher-Child Ratio, and Reporting Requirements 5. In addition, the licensee is to review the childcare reporting requirements video on our website located at https://ccld.childcarevideos.org/family-child-care-providers/ 6. Staff attending Step 2 Orientation for training purposes. 7. The licensee will be placed on required visits for two years; expires. 04/2023. Exit interview was conducted with District Manager Esmeralda Camarena and Director Maricruz Flores, whom are in agreement with the above. A copy of the reports were read, explained, and provided to Licensee. Page 2 of 2
