What the inspector wrote

AMENDED REPORT: TYPE A VIOLATION, CRIMINAL RECORD CLEARANCE, DISMISSED PER APPEAL Licensing Program Analyst (LPA) Alicia Mooberry conducted an unannounced Annual Random Inspection on this date. Upon arrival at 1:40 LPA met with Facility Representative Cheyanna Martinez and informed of the purpose of inspection. LPA observed Adult #1, providing care and supervision to children in care. Record review and interview indicate that Adult #1 does not have a required background clearance and has been present in the facility since February 2025, this poses an immediate risk to the health and safety of children in care, a $500 civil penalty is assessed. Licensee arrived at 2:00pm and provided tour of facility. LPA informed licensee of the purpose of inspection and provided form LIC 126, Inspection Entrance Checklist. LPA inspected rooms/areas on the facility sketch in which child-care services are provided and to which children have access. Per licensee the current hours of care provided are Monday \342\200\223 Friday 7:00am - 6:00pm. There were 6 children present, including 1 infant. Individuals residing in the home were discussed and noted. This is a one-story home which consists of two bedrooms, one bathroom, kitchen, living room, attached garage, front yard, storage shed (in backyard) and backyard (fenced). Per licensee, areas accessible to children in care include one bedroom, bathroom, living room, kitchen, and backyard (fenced). The children use the bathroom located in the hallway. The bathroom that children use was observed to be safe and sanitary. Off limit areas: 1 bedroom, garage (next to kitchen), storage shed in back yard. LPA observed cleaning products in garage, under kitchen sink and in the storage shed. Per licensee the kitchen is only used as a walkway to the backyard. LPA advised licensee to keep hazardous items inaccessible to children in care. Page 1 \342\200\223 Report Continues During this inspection, LPA reviewed staff and children's files. LPA observed the facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form posted in wall by entry way. Licensee was advised/reminded to post the required posted documentation in a location visible to parent/guardians of children in care. LPA reviewed Children\342\200\231s Roster form LIC 9040 and Emergency Disaster Plan (LIC 610A). Fire extinguisher indicated fully charged and was serviced on 10/7/24, Licensee was reminded that fire extinguisher needs to be serviced yearly. The home maintains telephone service via cell phone/LAN line. There are toys and other age-appropriate material available. Licensee states that there are poisons/insecticides stored in the locked storage shed. Licensee was reminded that all poisons must be locked, not only inaccessible to children. Per Licensee there are no firearms or weapons stored in the home, there are no bodies of water on the premises. Outdoor play area is in the back yard and observed to be fenced with age appropriate toys and play structure. LPA observed one small dog in the home. Per licensee, the pet is kept in daycare area and monitored when around children in care. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Based on the LPA's observations and records review 1 A and 2 B deficiencies will be cited today in accordance with California Title 22 Regulations. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child\342\200\231s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee/Director. A notice of site visit was given and must remain posted for 30 days. Appeal Rights were discussed and provided. Exit interview conducted and report was reviewed with the licensee, Eva Hoffman.
