What the inspector wrote

Complaint alleges a child sustained unexplained injuries in care. LPA reviewed incident reports for the classrooms and did not observe any unexplained injuries. Staff interviewed did not disclose any unexplained injuries to children. Parents interviewed stated they were happy with the care and supervision of their children. Based on the information gathered, and interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Director, Maricruz Flores. Page 2 of 2 During LPAs review of incident reports in the infant classrooms, LPA observed 11 incident reports documenting the same child (Child #1, (C1)) biting other children in care. The biting incident reports were observed for the time period from March 2023-January 2024. On one occasion, an incident report documents C1 woke up a friend by biting the child on the cheek. During interviews, Director spoke about a child who had markings from a marker on the child’s hand. Director stated the markings were “excessive” and stated “you can tell when a child is doing an activity and they miss and mark their hand but that was excessive”. Director stated she took a picture of the markings on the child’s hand and “followed up with the teachers…and said, make sure you are monitoring the markers cuz that was excessive”. Director provided LPA with the picture taken by Director showing the child with blue marker all over their hands. The Child Supervision Record for the following day, 12/21/23, shows a notation that the same child “came with blue marker all over hands”. Allegation: Staff do not ensure proper ratios are maintained Complaint alleges the facility is not in ratio during the morning hours. LPA reviewed Child Supervision Records (CSR’s) for the time period of 12/12/23-12/22/23 and observed that on four of the days, the facility was out of ratio during the morning hours. Additionally, during staff interviews, 4 of 9 staff interviewed disclosed that they have been out of ratio in their classroom. Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D. LPA Lilli Babcock informed licensee facility representative Maricruz Flores that this report dated 2/22/24 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Lilli Babcock informed the facility representative to provide a copy of this licensing report dated 2/22/24 that documents any Type A citations to parents/guardians of all children currently enrolled by the Page 2 of 3 next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
