What the inspector wrote

On 02/05/2025 at 1:30 PM, Licensing Program Analysts (LPAs) Mariah Aguirre and Mary Silva conducted an unannounced annual inspection to the above facility. A risk assessment was conducted upon entry. LPA’s met with Licensee Angelica Benavides who led LPAs on a tour of the facility. This is a large family childcare home and per licensee there are 7 children enrolled all of which are school age. Upon arrival to the facility, no children were present and per licensee her husband who is her assistant is picking up children. At the time of inspection, there was one adult present, the licensee. Licensee states her hours of operation are 6:30 AM to 7:00 PM Monday through Friday. This is a single-story home consisting of five bedrooms, two bathrooms, a den, a garage attached to the den, a living room, small dining area, a kitchen, and a front and back yard. Inside the home, per licensee the areas that are inaccessible to children in care is the five bedrooms and one bathroom. Per licensee these areas are all kept off limits to children in care during day care hours and is kept locked when children are present. The areas accessible to children are the living room, kitchen, den, garage converted into a day care room with ventilation, one bathroom, and the front yard. The back yard is currently off limits to children in care as licensee stated she has had to do work to the back patio area and it is not a safe area for the children to be in. In the living room of the home, LPAs observed a fire place that is covered by a glass cover and per licensee it is never open and stays shut. LPAs also observed workout equipment and weights in front of the fire place. LPAs instructed licensee to put the equipment away as it imposes a potential risk to the safety of children in care. Based on LPAs observation and per licensee there is one cat and a large dog on the premises of the home. The large dog is kept in the back yard locked behind a five-foot fence in an area inaccessible to children in care. Per licensee the cat is always kept inside the home and is often around the children in care. Per licensee, children do not nap in the facility at any time. LPAs reminded licensee that all individuals living in the home over the age of 18 must be fingerprint cleared. At this time a current children’s roster is available for review. Per licensee in the kitcheb the knifes are kept in a high cabinet out of reach of children in care and meals are provided to children in care. Meals provided are PM snack and dinner. Page 1 of 3 The following was observed and reviewed during this inspection. Cleaning compounds were observed to be inaccessible to children in care and are kept in the laundry area out of children’s reach. Per licensee, there are no poisons kept in the home. The restroom that children use was observed to be safe and sanitary. Per licensee, the form of contact kept at the facility is through licensee’s cellphone. Per licensee all parents of children enrolled have this form of contact with licensee. The home as well as the designated area that the day care operates in are observed to be clean and orderly. Per licensee, there is central heat and air in the home. There are appropriate toys readily available for children’s use. Upon observation, there is a first aid kit readily available for children’s use in the garage and is always kept locked per licensee, and licensee is the only one with a key. First aid kit was observed to be complete with all required materials inside, LPAs observed the following required posted documentation on the wall inside of the den. The following forms were observed. Facility License, (LIC) 9148- Emergency Disaster Drill Form, Publication (PUB) 394- Notification of Parent Rights, Licensing Form LIC 9040- Facility Roster. At 2:30 PM, LPAs observed a fire extinguisher serviced on 01/23/2025. LPAs reminded licensee that the fire extinguisher must be serviced yearly or purchased every year with the receipt attached for review. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Per licensee, emergency drills are conducted every month. The last drill was conducted on 01/19/2025. Smoking is prohibited in a licensed Family Childcare Home. Per Licensee, no one smokes in the home. Children and adult’s records were reviewed, including emergency information. All files for children and staff were complete. Per licensee, there are no poisons in the home but her husband does own six guns. All six guns are kept outside of the home in the back yard shed that is kept locked by a key only the husband has access to.These guns are six rifles and the ammunition is kept in boxes next to the safe inside of the shed that is kept locked at all times. All guns were observed to have the safety on. The area the guns are located is an inaccessible area to children in care. Licensee stated IMS is not being provided at this time. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations and discussed the Child Care Licensing Safe Sleep webpage at http://www.cdss.ca.gov/inforescources/child-care-licensing/public-information-and-resoucrces/safe-sleep as an additional resource. LPA also informed applicant/licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at http://www/cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Required infant forms were provided and reviewed for future infant enrollment. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Megan’s Law - Family Child Care Homes During the exit interview, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA advised the licensee to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov MyChildCarePlan.org – Centers and Family Child Care Homes Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California Based on Licensing staff observations and records review, no citations will be issued today. Licensee is in compliance California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days.
