What the inspector wrote

Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Annual/Random inspection at the above facility on 12/11/25 at 08:58 am. At approximately 09:05am LPA met with Hermelinda Anaya licensee who guided LPA on a tour of the facility. There were 04 children in care. Also present during this inspection was adult #1 (A1) who resides in the home. According to the licensee, 15 children are enrolled. Operation hours are Monday through Friday 06:00am \342\200\223 06:00pm. LPA conducted the inspection in Spanish. Upon arrival, LPA observed a 3-tier outdoor water fountain in the front yard. The water fountain was observed to be empty with no running water, no rocks, no plants, no gate surrounding the fountain, and accessible. Per licensee, the fountain has always been in the front yard as it was purchased with the home. The front yard is off-limits; however, parents and children walk through the driveway adjacent to the fountain and walk to the front of the home for pick up or drop off. This is a two-story home which consists of 5 bedrooms, 5 bathrooms, living room, dining room, kitchen, den (family room), garage (detached), front yard (fenced), back yard (fenced), and side yard (fenced). Areas accessible to children include living room, dining room, 2 bathrooms, and den. Per licensee, areas off limits to children and parents includes the entire second floor 5 bedrooms, 3 bathrooms, kitchen, front yard, side yard, and backyard. According to the licensee, there is 1 dog on the premises. Family members residing in the home are 5 adults and 3 minors. Licensee was reminded that any changes to the home must be reported to the department and submit proof of TB test for all adults. Page 1 of 4 LPA toured all areas identified on the facility sketch used by children during this visit and were inspected for safety, comfort, and cleanliness. Tour began in the entrance/living room where LPA observed living room furniture, (3) play pens, stored cots, an Elk taxidermy shoulder mount (based on goggle lens) on top of a table. LPA shook the Elk and observed that the antlers were not sturdy. Per licensee, the Elk is mounted to the wall though it's at a lower level, accessible to children and near their napping equipment. LPA advised the licensee to ensure the Elk is in good condition, well anchored, and potentially place it in an area off-limits to prevent any incidents or accidents. The stairs leading to the second floor is to the left once you enter the home. LPA observed that the second floor was accessible to children in care; however, licensee immediately placed a child proof gate and informed A1 \342\200\234this is what I asked you to put\342\200\235 (referring to the child proof gate). LPA then continued to tour the dining room which is adjacent to the living room and observed 3 feeding chairs, and a dining room table with chairs. According to the licensee, the kitchen is off-limits; however, LPA observed children are constantly walking through the kitchen. Licensee keeps all knives in a drawer with a functioning child proof lock. Tour then continued down the hallway towards the den which is located at the end/back of the home. LPA toured the den and observed age-appropriate toys and materials for children. LPA also observed a barricaded fireplace and an elliptical machine. Per licensee, she\342\200\231s always had the elliptical machine and previous LPAs have allowed her to have the machine in the areas where children have access. LPA advised the licensee that it is best practice to keep the elliptical in an area that is off-limits to children to prevent any incidents or accidents; however, licensee stated that children are aware not to get on the machine. There is a bathroom in the den that is used by children. LPA toured the bathroom and observed cleaning products and shampoos that were accessible to children. LPA informed the licensee that cleaning products and shampoos are inaccessible. Per licensee, A1 cleans the bathroom and must have left the cleaning products on the floor. LPA discussed with the licensee that it is their responsibility to ensure that the home is safe at all times. Licensee then guided LPA to the bathroom where diaper changes and potty training takes place. The bathroom is located down the hallway/behind the kitchen. LPA observed a blower with their battery that was being charged. According to the licensee, she was using the blower to clean the yard and needed to charge machine. LPA discussed with the licensee that it is best to charge outdoor equipment in an off-limits area to prevent incidents or accidents. According to the licensee, the isolation area is in the den with supervision. There\342\200\231s also a first aid kit readily available. Per the licensee, there are no firearms, weapons or in the home. At 09:17 am smoke and carbon monoxide detectors were observed to be operable. The valve on the required 2A10BC fire extinguisher indicates fully and was serviced on 01/29/25, per the attached service tag. Per State Fire Marshall standards, fire extinguishers shall be serviced annually. Page 2 of 4 LPA observed the following required posted documentation in the entrance and den: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form, LIC 610- Emergency Disaster Plan and PUB 269 California Child Passenger Safety Law. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill conducted was on 10/2025. Children\342\200\231s roster was available for review during the inspection; however, it was not current. Per licensee, food is provided to children. Licensee was advised that if food is brought from the children\342\200\231s homes, all containers must be labeled with the child\342\200\231s name and properly stored or refrigerated. The facility has a working telephone, ventilation, and heating. Children and staff records were reviewed. Children and staff names were documented on the LIC 811, and a copy was provided to the licensee during the inspection. LPA observed 1 out of 7 children had a blank LIC 627, 3 out of 7 children were missing immunizations, 2 out of 7 children were missing LIC 700, 2 out of 7 children were missing LIC 282, and 1 out of 7 children was missing LIC 995A. Per licensee, infants do not nap therefore the 15-minute sleep log does not apply. Licensee does have the sleep log form available if needed. AB1207 Mandated Child Abuse Reporting \342\200\223 On or before March 30, 2018, any person who works in a child care facility shall complete the training and renew the training every 2 years. LPA also informed licensee of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Page 3 of 4 Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee Hermelinda Anaya confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA discussed and recommended the technical support program (TSP) and provided a brochure. The following deficiencies were cited in accordance with Title 22 of the California Code of Regulations and Health & Safety Codes. Please see 809D for documentation of deficiencies.
