What the inspector wrote

On 5/20/2024 at 2:00 pm an unannounced Case Management – Deficiencies inspection was conducted by Licensing Program Analyst (LPA) Carolyn Tuba who was there to conduct a separate inspection visit and during the course of the investigation a deficiency were discovered. A Covid risk assessment was conducted. LPA took a census of 5 children in care with 2 staff. During the visit at approximately 10:30 am. LPA was inquiring about clearance of staff that were in the classroom. LPA found that a staff member was not on the Employee Clearance Report. LPA inquired and found that staff had fingerprinted on December 7, 2022, however due to not submitting required documentation that Guardian requested, the application was closed on March 7, 2023. LPA informed Assistant Director, Susan Stubbs who sent staff to conduct fingerprint clearance. LPA is requesting a copy of the receipt sent via email or via text. LPA informed Assistant Director that the staff may not return until clearance is approved. Assistant Director was under the impression that she had clearance but was unable to provide clearance letter. Staff was currently working in the infant room and has assisted as a driver for the facility. LPA informed Assistant Director that when they receive the yearly facility staff roster, she should check to make sure everyone is accounted for, or she can call the Department for confirmation. Assistant Director is attempting to gain access to Guardian to have access to all clearances and associations. During this visit a civil penalty was assessed. All adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a Page 1 of 2 maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The following deficiency listed on the attached LIC 809 (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiency that are being cited need to be cleared to protect the children’s health & safety. One (1) Type A - A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A notice of site visit was given and must remain posted for 30 days.
