Inspector’s narrative

What the inspector wrote

has expressed difficulty to attend school. The reporting party stated this behavior may be related to an incident that occurred during a Christmas activity. LPA conducted staff interviews. No staff reported yelling at children or witnessing any staff yelling at a child. All staff stated that they are trained in behavior guidance and have frequent meetings to address the topic. All staff stated that they are also all certificated in mandated reporter training and are aware of a child\342\200\231s personal rights per Title 22 regulations. LPA Perry conducted child interviews and no disclosures were made related to staff yelling at children. LPA Perry conducted parent interviews and no disclosures were made pertaining to the above allegations. LPA observed staff consistently treating children respectfully and in an appropriate manner and tone of voice. Children were observed following their daily schedule and being escorted to the restroom regularly and as needed. Parents were observed to be informed of toileting procedures, including the requirement for extra clothing and notification of incidents via in-person communication, email, and/or phone call as needed. During multiple inspection visits, LPA Perry did not observe any violations related to children\342\200\231s personal rights. Children were observed during drop-off and pick-up to appear happy, comfortable, and excited to attend the facility. Staff were observed communicating appropriately with parents and children. LPA reviewed the Parent Handbook and Employee Handbook and obtained documentation indicating staff guidance procedures were reviewed during recent staff meetings. LPA did not observe or hear any yelling, screaming, or inappropriate conduct by staff. Allegation #2: Staff use inappropriate forms of punishment. The Reporting Party stated that Child#1 (C1) disclosed being made to sit or stand in time-out for an unknown length of time. During parent interviews no disclosures were made pertaining to the above allegations. Parent #4 and Parent #5 stated that staff communicate appropriately with children and use redirection and calm guidance when children display challenging behaviors. Parents stated that staff speak to children at their level and may have a child sit briefly to refocus. Staff stated that when a child is experiencing challenging behavior, the child is spoken to at eye level and redirected appropriately. Staff stated that if needed, the child may sit next to a teacher briefly for \342\200\234quiet time\342\200\235 time with supervision whole the child sits next to a teacher. Staff stated that children are not placed in corners, isolated, or required to stand for time-out. During child interviews no disclosures were made pertaining to the above allegations. Child #4 (C4) stated that quiet time consists of sitting next to a teacher briefly and then returning to play. Child #2(C2) and Child #6 (C6) stated that they get \342\200\234quiet time\342\200\235 and sit next to a teachers and talk about what they did. No child disclosed inappropriate discipline practices. LPA Perry observed staff consistently treating children with respect. Children appeared comfortable in their classrooms and interactions with staff. LPA Perry observed positive supervision and appropriate guidance practices throughout the investigation. Declaration was obtained by facility director stating that time outs are not used. Based on interviews conducted and information gathered, there was no evidence to support the allegations. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are UNSUBSTANTIATED. An exit interview was conducted with the Summer (Xia) Yan. A copy of this report and appeal rights were provided and discussed. A NOS (Notice of Site visit) was provided. The report must be posted for a period of 30 days.
