What the inspector wrote

Page 2 Per the Licensee, she allowed the child to throw the items instead of stopping her right away to allow her to express her emotion. In the video, it is heard that the Licensee attempted to stop the child verbally. Per Licensee, she did not intervene physically because she did not want Child 1 to react in a potentially harmful way towards her. In the video, Licensee was ready to react when Child 1 walked towards the wooden play kitchen. Per Licensee, she began recording once Child 1 began throwing the items around the yard. In the video observed by LPA, other children are seen in the background, and they are sent inside the home with Staff 1 soon after. During today’s visit, LPA did not observe any hazards and children’s needs were being met. Interviews with parents do not corroborate the allegation. Interviews conducted with Licensee and Staff 1 did not confirm that Staff 1 pulled Child 2’s ear. Per Staff 1, they recall attempting to put Child 2’s hair in a pony tail by pulling their hair back and stated they must have passed their hands by Child 2’s ear at that moment. Based on interview and observation, the allegations that the Licensee is not providing a safe environment for children in care and that the assistant pulled child 2’s ear are unsubstantiated. Unsubstantiated – A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. Exit interview conducted with Licensee, Leticia Aquino. A copy of the report and a notice of site visit were provided.
