What the inspector wrote

Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. LPA met with Director Vicky Gutzwiller, who guided LPA on a tour of the facility. LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided Lead in water report with all the required forms, which included LIC 9276, LIC999 and LIC9275 to LPA during today\342\200\231s inspection. The Department did not receive notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report which was provided by the Director indicated the facility was inspected and samples were collected on 12/23/2022 and on 03/24/2023. A Faucet was reported with 5.5 ppb or greater lead exceedance levels as follows: \302\267 J-CF-P - Class Room E (2-3 Year olds) Faucet - Results 8.3ppb Director states that the parents of the children bring their own filled water bottles or Sippy cups with water from home since Covid. There is a water pitcher filled with water from the school kitchen which did not test with action level exceedance, and used if a child does not bring their own water bottle. Staff would only use faucet J for cleaning active tools such as painting supplies. The drinking fountain in the same area as this faucet tested fine, however the children don't use the drinking fountain. REPORT CONTINUES PAGE 1 of 2 Facility has a catering services for meals and snacks and food prep is conducted in the kitchen which did not test with action level exceedance. Dry goods and fruit are prepped in the kitchen before being brought to the classrooms. Fifty three water samples were drawn on 12/23/2023 of which one ample failed in classroom E. On March 4, 2023 the faucet was retested after it was flushed for 3 weeks as per DSS requirements. The faucet failed a second time. The facility removed the angle stop. supply line and faucet and replaced them with new components. The faucet was flushed again for 3 weeks and a new sample was collected on June 28, 2023. the result of this test is non-detected for lead. The faucet was placed back into services. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. Notice of Site Visit was provided and must remain post for 30 consecutive days. A copy of PIN 21-21-CCP and appeal rights were provided to facility today.
