What the inspector wrote

On 7/11/25 Licensing Program Analysts (LPA) Tyler Reyes conducted an unannounced Annual/Random inspection. LPA met with Licensee Aponte, Julia and provided an Entrance Checklist-Family Child Care Homes LIC 126. LPA conducted a tour of the facility let by Licensee Julia. LPA observed (3) children in care. Hours of operation 7AM-6PM Monday through Friday. The facility is licensed to care for MAX. CAP (WHEN THERE IS AN ASSISTANT PRESENT): 12 - NO MORE THAN 4 INFANTS, CAP. 14 - NO MORE THAN 3 INFANTS, 1 CHILD IN KINDERGARTEN OR ELEMENTARY SCHOOL AND 1 CHILD AT LEAST AGE 6. During the inspection, the following individuals were present in the home: Licensee and Staff 1 (S1 -S2)All adults present in the home have obtained a criminal record clearance or exemption. LPA informed that any individual that has direct contact with the children are required to have a criminal record clearance or exemption. Facility Sketch: The facility is a two-story structure that consists of a Front yard, living room, dining room, entrainment room, kitchen (4) bedrooms, (2) restrooms, detached garage, and enclosed backyard. On-Limit: Font yard, living room, dining room, and entrainment room Off- Limit: Kitchen, (4) bedrooms, (2) restrooms, garage, and backyard. Facility Postings: LPA observed the required positing in the living room: Facility License, PUB 394 Notification of Parents\342\200\231s Rights, LIC 9148 Earthquake Preparedness, and LIC 610A Emergency Disaster Drill Plan. LPA provided an updated copy of PUB 394 Notification of Parents\342\200\231s Rights. Page 1 of 4 . Pediatric CPR/First Aid in Pediatrics Certification: Licensee American Red Cross Pediatric First Aid /CPR - Completed 9/14/24 Validity 2 years and S1 American Red Cross Pediatric First Aid /CPR - Completed 9/14/24 Validity 2 years Emergency Disaster Drill: June 17, 2025 Transportation: Per Licensee transportation is not provided Infants: LPA observed (1) infant Child 2 (C2) in care napping with a pillow which poses potential health and safety risk. LPA discussed infant safe sleep with Licensee. Cribs or play yards shall be free from all loose articles and objects. LPA observed 15-min Infant Sleep Log last documented date 7/11/25 and time 1:53PM. LPA discussed that facility shall supervise infants 0 \342\200\223 24 months while sleeping. Per Licensee all sheets are washed every other day and as need. LPA provided Infant Safe for Family Child Care Homes from California -DSS-Manual -CCL Items not permitted: LPA provided the Licensee with a picture listing some of the items not permitted in a family childcare home, which include a bouncer, a jumper, and a walker. These items are not allowed to be on the premises of the facility. LPA observed in the living room a child bouncer in on-limit entertainment room which poses a potential health and safety risk. Meals: Per Licensee children will have meals in dinning room. Licensee was advised to ensure all food brought from home is properly labeled and stored. Per Licensee no children have reported food allergies. Medication: Per Licensee the facility will provide incidental medical services. If required, medication will be inaccessible to children by centrally storing and locking. Medications will be administered in accordance with PIN 22-02-CCP, which outlines requirements for proper storage, documentation, and staff training. Personal medication is kept in the off-limit kitchen cabinet. The following on-limit areas that will be used by children were inspected for safety, comfort, and cleanliness. Heating and cooling is provided by central air conditioner. LPA observed age-appropriate toys and learning materials. Telephone service is provided via cell phone. LPA observed fire extinguisher 3-A:40-B:C located in entertainment room with a purchase receipt 3/9/25. Family Child Care Homes are required to maintain a new or serviced fully charged fire extinguisher which is at least a 2A:10BC annually. LPA observed a fireplace in the entertainment room screened and covered by a floor mat. LPA observed outlet covers on the electrical outlets. LPA observed an operable smoke and carbon monoxide detector dinning room. Page 2 of 4 Poisons/Cleaning Products: Per Licensee no poisons are kept on facility grounds. LPA observed cleaning products centrally stored underneath kitchen sink secured by child safety latch. LPA informed the Licensee to ensure that child safety latches are in operable condition and appropriate for the ages of children enrolled. LPA observed upon record review C4 with an age of 10 years. Outdoor: Per Licensee children backyard is off-limit. No pool, spas or other bodies of water. LPA discussed and provided copies of PIN 25-06 Extreme Heat Prevention. Staff Files: LPA reviewed Licensee and S1 file for the following documentation: LIC 9052 Employee Rights, LIC 9108 Statement Acknowledging Requirements to Report Child Abuse, Proof of Immunizations, and Mandated Reporting Training Certificate Licensee had the required documentation. (1) of (2) staff had required documentation. Licensee was missing proof of TB immunization clearance which poses a potential health and safety risk. Children Files: LPA reviewed (2) children files for the following documentation: LIC 282 Affidavit Regarding Liability Insurance, LIC 700 Identification and Emergency Information, LIC 627 Consent for Emergency Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights, and LIC 9224 Acknowledgment of Receipt of Licensing Reports was not applicable. (2) of (2) children had required documentation. LPA conducted an interview with Licensee regarding the following topics: infant safe sleep practices, the facility\342\200\231s plan to support children\342\200\231s learning and development, procedures for keeping parents informed, strategies for managing challenging behaviors, and protocols for managing food allergies. LPA discussed reporting requirement and the Licensee\342\200\231s responsibilities as a mandated reporter, including the obligation to report to Community Care Licensing and emergency personnel when necessary. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Page 3 of 4 LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. This facility provides Incidental Medical Services \342\200\223 IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children\342\200\231s, personnel, and administrative records. For IMS information see PIN 22-02-CCP . Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the LICENSEE Julia, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. Exit interview conducted and Appeal Rights provided with Licensee Julia. Please see attached LIC 809-D for citations. (3) Type B's were issued.
