Page 2 Based on LPA interviews conducted and documents reviewed and received, the preponderance of evidence standard has been meet, therefore the above allegation is found to be SUBSTANTIATED at this time. California Code of Regulations, 101223(a)(1)(2)(3) —Personal Rights--To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning is being cited on the attached LIC 9099D. LPA Reyes informed the Director, Aysegul Inceoglu that this report dated 07/11/2023 document(s) 1 Type A citation. Type A citation shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care. LPA Reyes informed the Director, Aysegul Inceoglu to provide a copy of this licensing report dated 07/11/2023 that documents 1 Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the Director, Aysegul Inceoglu. REPORT END 2 of 2 Page 2 Personal Rights: Staff did not provide adequate supervision to day care children. Per interviews and declarations from several staff members, their were no disclosures of any staff members not attending to children due to being on their personal telephone. Reporting Requirements: Facility did not follow reporting requirements. Per complainant, 5 to 8 kids were out with the stomach bug, however per documents reviewed and received from the facility their was children with the stomach flu however their was not an outbreak to report. Children had the stomach flu at different time periods and not 2 or more at the same time. LPA obtained records of children who were ill and when. Other: Staff are not properly trained: Per interviews and declarations from several staff members, their were no disclosures of any staff members not being properly trained. Most staff stated they were trained by job shadowing and the Montessori job aids. Based on interviews, record review and received and observation, the above allegations are deemed UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred. An exit interview was conducted, and a copy of this report was provided to Director, Aysegul Inceoglu, along with the Notice of Site Visit and Appeal Rights. REPORT END 2 of 2

To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, etc...This requirement was not met as evidenced by, around August 2022, staff #2 pulled a child's hand out of staff #1 hand and when doing that staff #1 hand flew and hit a door and staff #2 yelled at staff #1 in front of a child.
