What the inspector wrote

On 02/06/26 at 8:45am, Licensing Program Analyst (LPA) Diana Ortiz conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in water fixtures in the facility. LPA entered the main office where LPA checked in. LPA was then guided to the preschool facility and entered through the side gate located on the east side of Mountain View elementary school. There is a ramp that leads to the preschool program. LPA met with teacher Madisenne Burciaga. Census was taken, there were 16 children and three (3) staff present during inspection. At 9:20am, Facility representative, Esther Adams arrived and led LPA on a tour of the facility. LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility representative during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. On 01/20/2026 facility provided facility sketch and required forms LIC 9276, LIC 999 and LIC 9275 to the department via email. On 01/06/2026, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 12/22/2025. Faucets reported with 5.5 ppb or greater lead exceedance levels were as follows:- \302\267 Sample Site F (36.000 UG/L) \342\200\223 Faucet with attached drinking fountain, currently not in use. Page 1 of 2 Facility representative stated the facility has not used the attached fountain, (F),in the classroom for drinking, only used for hand washing. Children bring water bottles from home, and the facility provides drinking water in-doors and out-doors. LPA observed two wall mounted drinking fountains. One is standard and the other is a drinking fountain with a bottle filling station on top. Per facility representative, the faucet in the classroom is used to wash hands and containers. No food is prepared in the classroom. The facility provides breakfast for the AM class, and lunch for the PM class. Food is prepared in the school cafeteria and then transported to the preschool class. The facility has capped off the fountain which was attached to the faucet, making it inaccessible to children and staff (pictures taken). The Department received notification from the State Water Resources Control Board(SWRCB), Division of Drinking Water (DDW) on 7/15/2024 that faucets mentioned above still show a lead exceedance. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety. A notice of site visit was also provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the facility representative, Esther Adams.
