What the inspector wrote

Based on the preponderance of evidence, the standard has been met, therefore, the above allegations are found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D. Upon receipt of this report, the licensee shall post any licensing report documenting a type \342\200\234A\342\200\235 citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the director will provide copies to the parents of the children in care for up to one year. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was explained and provided to the Director. A notice of site visit was given and must remain posted for 30 days. Appeal Rights provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Director, Aida Dejong. Appeal rights and procedures were provided during this visit. page 2 of 2

    OPERATION OF A FAMILY CHILD CARE HOME

    102417(b)Operation of a Family Child Care Home. The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. This requirement was not met as evidenced by: Based on LPA observation, the licensee did not comply with the section cited above, facility has an unpleasant odor due to the numerous pets in the facility. Facility was observed to have four animals(cats/dogs) in the kitchen, eight animals in a bedroom(cats/dogs) and an additional eight animals in the garage(peacocks). LPA noticed a strong unpleasant odor due to the numerous pets in the facility. which poses/posed a potential health, safety or personal rights risk to persons in care.

    102423(a)(2) Personal RightsEach child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative.... This requirement was not met as evidenced by: Based on interviews conducted, the licensee did not comply with the section cited above as evidenced by a disclosure made by a daycare child, which poses an immediate health, safety, and personal rights of children in care.
