Page 2/4 -Pertaining to the allegation that the “ Facility is unsanitary ”: According to the RP, there is a toilet outside which is used by children; once the children have finished using the toilet, the provider cleans it out with a bucket and throws the contents in the bushes, plants, or grass area. During the initial inspection, LPAs observed a child-size toilet (not a potty chair) outside on the patio not connected to plumbing in front of a raised planter area on which children don’t play. The three staff and one adult interviewed provided corroborating statements that the outside toilet is used by children who are potty training. When asked how the urine and are disposed of after the children have used it, the adult and two of the staff disclosed that the urine is disposed of on the dirt, while one staff stated that it’s carried to the inside toilet and dumped. As to the feces, the adult stated that it’s disposed of in the bushes, plants or grass area outside; while one staff stated it’s wrapped in a paper towel and thrown in the trash cans which are just adjacent to where the toilet is located outside and two of the staff stated that it’s either put in a trash bag or in the inside toilet after it has dried. As the regulation for potty chairs states that, “After each use, the potty chair shall be promptly emptied into a flushing toilet, and all surfaces shall be thoroughly cleaned and disinfected,” the allegation that “Facility is unsanitary” has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 102423 Personal Rights is being cited on the attached LIC 9099D. Page 3/4 A Notice of Site Visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. LPA Bell informed Licensee Veronica Jimenez that this report dated 05/25/22 documents one Type A citation(s) which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Bell informed Licensee Veronica Jimenez to provide a copy of this licensing report dated 05/25/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly-enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Page 2/3 -Pertaining to the allegation that “Day care children are being transported to and supervised in an unlicensed home”: According to the RP, when the licensee has too many children, the provider or one of her assistants will take the excess children to another house to be watched. Per the one adult interviewed, the youngest and the oldest daycare children are taken to the other residence and it is only when the licensee will be over her licensed capacity of 14 children. Though one staff corroborated that some of the older children may be taken to another residence after school, when LPAs conducted surveillance on the residence, nothing was observed and no disclosures were made by parents. Therefore, based upon the evidence as presented above, the allegation that “Day care children are being transported to and supervised in an unlicensed home” has been determined to be Unsubstantiated. This agency has investigated the complaint alleging that ““Day care children are being transported to and supervised in an unlicensed home” and that there was a violation of Title 22, Division 12, Chapter 1, Article 1, Section 102352 Definitions. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. No deficiencies are being cited for the allegation listed above.     PERSONAL RIGHTSTo receive safe, healthful, and comfortable accommodations, furnishings, and equipment.-This requirement is not met as evidenced by: three staff disclosed that urine from the toilet used as a potty chair is disposed of on dirt and feces may be disposed in a trash bag, in the dirt or in the inside toilet after it has dried. According to CCC regulation, the potty chair shall be promptly emptied into a flushing toilet.*This poses an immediate risk to the health and safety of the children in care.*
