Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Annual/Random inspection at the above facility on 05/05/26 at 09:24 a.m. At approx. 09:30 a.m., LPA met with licensee Martina Tovar who guided LPA on a tour of the facility. There were 07 children present in the home. Also present in the home was the licensee’s husband/assistant. According to the licensee, 08 children are enrolled; however, 1 child was not present due to being ill. Operation hours are Monday – Friday 07:00 a.m. – 05:00 p.m. LPA conducted the inspection in Spanish. This is a one-story home which consists of 4 bedrooms, 2 bathrooms, living room, dining room, kitchen, family room, laundry room, detached garage, front yard, and backyard (fenced). According to the licensee, children use the living room (receiving room), dining room, kitchen, family room, detached garage (activities), 1 bathroom, and backyard. Family members residing in the home are 2 adults and 0 minors. According to the licensee, there are no pets on the premises. LPA toured all areas identified on the facility sketch used by children during this visit and were inspected for safety, comfort, and cleanliness. Tour began in the living room/receiving room where LPA observed furniture and children’s cubbies to store personal belongings. LPA was then guided to the kitchen and dining room where LPA observed a dining room table with chairs and a child sized table with chairs. According to the licensee, children eat in the dining room. There is also a well mounted child proof gate between the living room and kitchen, and between the dining room and family room. LPA toured the kitchen and observed that the kitchen cabinets have child proof locks. LPA observed that the licensee keeps the knives in a top cabinet inaccessible to children. Tour continued to the children’s bathroom which is near the family room. LPA observed that the children’s bathroom is safe and in sanitary conditions. LPA observed off-limits areas inaccessible to children. Page 1 of 4 According to the licensee, children use the detached garage for activities. LPA observed that the garage has a variety of age-appropriate toys, materials, and equipment for children. The garage is equipped with a smoke and carbon monoxide detectors, fire extinguisher, and a mini split for AC/heater. At 09:42 a.m., smoke and carbon monoxide detectors were observed to be operable. The valve on the required 2A10BC fire extinguisher indicates fully charged and was serviced on 01/08/26, per the attached service tag. The licensee has a first aid kit readily available. LPA observed the following required posted documentation in the living room/receiving room: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form, LIC 610- Emergency Disaster Plan and PUB 269 California Child Passenger Safety Law. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill conducted was on 04/15/26. Children’s roster was available for review during the inspection. Per licensee, food is provided to children in care. Licensee was advised that if food is brought from the children’s homes, all containers must be labeled with the child’s name and properly stored or refrigerated. The facility has a working telephone, ventilation, and heating. Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. Per the licensee, there are no firearms, weapons or bodies of water in the home. According to the licensee, children use the back yard (first portion) for outdoor play. LPA observed adequate shade and age-appropriate play equipment. The back yard is completely fenced. The back part of the back yard is off-limits to children and was observed to be inaccessible. LPA did not observe any objects that could be hazardous to children in care . LPA advised the licensee to check with the American Standard Testing Materials for Playground Guidelines and/or to use the manufactures recommendations for the playground equipment in efforts to be more in line with safety guidelines. Licensee understands that children should be supervised at all times. Page 2 of 4 Children and staff records were reviewed . LPA also observed that 1 out of 7 children's files did not have their immunizations up to date. According to the licensee, the parent has been attempting to take the child to receive their missing vaccine; however, it has not been possible. LPA provided a technical violation. Children and staff names were documented on the LIC 811, and a copy was provided to the licensee during the inspection. AB1207 Mandated Child Abuse Reporting – On or before March 30, 2018, any person who works in a child care facility shall complete the training and renew the training every 2 years. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee Martina Tovar confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. At this time, the facility is in compliance with California Title 22 Regulations. Therefore, there are no deficiencies being issued today.
