What the inspector wrote

Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced Case Management inspection for the purpose of following up on an incident reported to the Department on 03/19/2026. Upon arrival at 8:35am, LPA met with Facility Representative Liz Salinas, to whom the purpose of the inspection was explained. A tour of the facility was conducted and census was taken. There were 31 children and 7 staff members present. On 03/18/2026, Child #1 informed Staff #1 and 2 that Staff #4 (S4) had pulled their ear. During today's inspection, LPA conducted interviews with four staff members and two children. Information for San Gabriel Police Dept (SGPD) Incident Report was obtained. LPA was unable to get in contact with the Officer from SGPD during today's inspection. Documentation in the form of written statements from staff were obtained and reviewed. During interviews, all staff disclosed that there was a physical incident that did take place. Staff #4 stated that they were assisting with helping C1 stay quiet and try to rest during nap time. They had lost balance while down on the ground with C1 and had applied pressure to C1's ear accidentally. S4 states that they began to massage C1's ear. In Staff #2's interview and written statement, they state that they did observe S4 telling C1 "sorry, sorry" during nap time. C1 disclosed to S2 that S4 had pulled their ear. Per Staff #1, the following day C1 disclosed to them that S4 had pulled their ear and showed them with their hand. When LPA conducted interview with C1, they made no disclosures regarding S4 or the incident that took place. Based on the information above, there was no first hand observation of S4 pulling C1's ear. Child #1 was unable to provide information about S4 or disclose any incident that may have happened or negative statements. Though a physical incident may have happened between S4 and C1, it may have been an accident, as S4 states they lost balance. REPORT CONTINUES PAGE 1 of 2 LPA is providing an Advisory Note-Technical Assistance for the facility when it comes with helping other staff members. Multiple staff, during interviews, provided mention of additional stress on Staff #4. The Advisory Note will be used to make facility aware recognizing when staff members need assistance or a break. Though the incident may have happened, there was not enough evidence to prove that it did or did not happen. At this time, no violations are being cited in accordance with California Title 22 regulations A notice of site visit was given and must remain posted for 30 days.
