What the inspector wrote

In regards to allegation # 1 Licensee did not provide adequate supervision of the daycare children while in care- LPA conducted interviews with complainant, parents, children and staff. LPA conducted interviews with staff # 1 and 2. Staff corroborated that child was new to the facility and getting used to the routine. Per Staff 1 & 2 on the day in questioned they were getting children ready for water play and they were all by the front door ready to go outside. Staff # 1 was in the front by the door and Staff # 2 in the back of the group. Per Staff # 1 they were in the front when a child ran back- Staff # 1 proceeded to get child who ran back and child # 1 ran out the front door and fell off the steps. Per Staff # 2 they were helping another child get dressed. LPA conducted interviews with parents and children. Parent\342\200\231s statements corroborated that they are happy with the care that their child receives and do not have any concerns about the staff or supervision. Child # 2 disclosed that a child did fall off the steps, additionally child # 2 disclosed that \342\200\234everyone\342\200\235 was walking out when incident occurred. This agency has investigated the complaint alleging- licensee did not provide adequate supervision of the day care children while in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated. No citations being cited for this investigation A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above in that LPA's observed assistant by herself with 8 children 3 being infants, which poses an immediate health, safety or personal rights risk to persons in care.
