What the inspector wrote

Licensing Program Analyst (LPA) Jeanette Estrada conducted a case management inspection for the purpose of evaluating two classrooms (classroom 2105 and 2106) for a requested capacity decrease. LPAs met with Facility Representatives, Early Learning Center Managers (ELCM) Keokuk Legarde and Olivia Ugarte. There were no children present since the program is currently closed for the summer. All indoor and outdoor activity space utilized for the children was inspected today. LPAs informed ELCM Keokuk Legarde that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. This is a full day program located on the premises of Birney Elementary School. The program operates Monday through Friday from 7:45 AM to 2:45 PM and serves children ages 2 to 5 years old. Currently the program operates in classrooms B 36, B 37, 2105 and 2106. The program is requesting a capacity decrease since classroom B36 will be used as an office space and B37 will be closed. LPA inspected indoor activity space-Room 2105 and 2106. These two classrooms are in the 2000 building next to the shared program outdoor area. Classrooms 2105 and 2106 are connected via a small hallway which has a sliding door for separation. Each classroom has two separate restrooms with one toilet each. There is one hand was sink located right outside the restrooms and another hand wash sink on an opposite wall in the classrooms. The facility also has a waiver on file allowing use of the elementary school restrooms. There are 5 toilets and 4 sinks in the restroom in building 2000 and 5 toilets and 7 sinks in the restroom in building 1000. This is sufficient for the requested capacity. Total indoor activity space measured for classrooms 2105 and 2106 is 1704.00 sq. ft., which is sufficient to accommodate the requested capacity of 48 Children. Page 2 LPA observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots, bookshelves, and other activity supplies for the children. Drinking water is available in the classrooms via a water fountain in classrooms 2105 and 2106. LPA observed all hazardous items to be inaccessible to children. There are no bodies of water or weapons on the property. Fire clearance was granted on 6/17/25. The facility currently has a fully fenced playground area. The chain link fencing is at least four feet high. The total square footage for all the outdoor activity space is 8697.69 sq. ft., which is sufficient to accommodate the requested capacity. There is a waiver on file for shared use of the outdoor area with the kindergarten classroom and the TK classroom. Shade is provided via trees, umbrella and canopy in the yard. There are sufficient outdoor age-appropriate toys and play equipment available on the playground. There is a climbing structure on the playground for children ages 2-12 years old which is properly anchored. There is adequate cushioning in fall zones of climber provided by cushioned rubber flooring. Facility Representative stated there is an active supervision plan in place when the structure is in use. Outdoor drinking water is available via water fountains. LPAs observed all hazardous items on the playground to be inaccessible to children. Drinking water was tested for lead on 5/29/25 with no action level exceedance. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP . Facility Representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. LPAs reviewed with the Facility Representatives the LIC 311A, Records to Be Maintained at The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted. Facility Representatives were informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. No corrections are needed. A license for 48 children ages 2-5 years old in classrooms 2105 and 2106 will be granted upon Department review. A notice of site visit was given to Facility Representatives and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
