What the inspector wrote

Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Annual/Random inspection at the above facility on 12/19/25 at 01:45 pm. At 01:50pm LPA met with Martha Huerta licensee who guided LPA on a tour of the facility. There was 01 child in care. According to the licensee, 01 child is enrolled. Also present was the licensee\342\200\231s adult daughter (A1), licensee's daughter's boyfriend (A2), and infant (licensee\342\200\231s grandson). Operation hours are Monday through Friday 07:00am \342\200\223 05:00pm. LPA conducted the inspection in Spanish. This is a one-story home which consists of 2 bedrooms, 1 bathroom, living room, kitchen, front yard, and backyard (fenced). Areas accessible to children include living room, kitchen (walkway), bathroom, and backyard (first half). Per licensee, areas off limits to children and parents includes 2 bedrooms, front yard, and second half of backyard. According to the licensee, there is 1 dog on the premises. Family members residing in the home are 4 adults and 1 minor; however, after review of fingerprint clearance licensee retracted her statement and stated that there were 3 adults and 1 minor residing in the home. Later licensee clarified that there are 2 adults and 1 minor residing in the home. At approximately 2:13pm LPA observed A2 come out from the hallway and walk towards the living room. LPA asked the licensee who A2 was, and licensee stated that A2 was visiting due to being the father of the licensee\342\200\231s grandson and that today was the first time A2 was visiting his son. A1 and A2 left the facility at approximately 2:15pm; however, licensee provided care and supervisor for their grandson. LPA toured all areas identified on the facility sketch used by children during this visit and were inspected for safety, comfort, and cleanliness. Tour began in the living room LPA observed living room furniture, (1) mattress, (1) bassinet being used by the licensee\342\200\231s grandson, (1) boppy pillow (not in use) and (1) bouncer (not in use). Page 1 of 4 LPA discussed approved and prohibited safe sleep equipment. Licensee understands that prohibited safe sleep equipment should be off-limits or not in the home. Licensee stated that the kitchen is off-limits; however, children must walk through the kitchen to access the back yard. LPA observed that the licensee keeps the kitchen knives in a high cabinet that makes it inaccessible to children. LPA toured the bathroom used by children which is located down the hallway from the living room. LPA observed the children\342\200\231s bathroom is safe and in sanitary conditions. There\342\200\231s also a first aid kit readily available. At 2:02 pm smoke and carbon monoxide detectors were observed to be operable. The valve on the required 2A10BC fire extinguisher indicates fully and was serviced on 11/30/24, per the attached service tag. Per State Fire Marshall standards, fire extinguishers shall be serviced annually. LPA observed the following required posted documentation in the kitchen: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form, LIC 610- Emergency Disaster Plan and PUB 269 California Child Passenger Safety Law. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill conducted was on 08/04/25. Children\342\200\231s roster was available for review during the inspection and was observed to be current. Per licensee, food is provided to children. Licensee was advised that if food is brought from the children\342\200\231s homes, all containers must be labeled with the child\342\200\231s name and properly stored or refrigerated. The facility has a working telephone, ventilation, and heating. Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. According to the licensee, there are no firearms, weapons or bodies of water in the home. Children use the back yard for outdoor play. LPA was guided to the backyard (first half) where LPA observed furniture, washer, dryer, table with chairs, materials and equipment for children. Licensee has barricaded the back porch area where children only have access to make the rest of the back yard inaccessible. LPA observed there is trampoline in the far left corner of the backyard. According to the licensee, the trampoline is off-limits to children in care. LPA observed the back yard has adequate shade and equipment for children. LPA did not observe any objects that could be hazardous to children in care. LPA advised the licensee to check with the American Standard Testing Materials for Playground Guidelines and/or to use the manufactures recommendations for the playground equipment in efforts to be more in line with safety guidelines. Licensee understands that children should be supervised at all times. Page 2 of 4 Child and staff records were reviewed. Child and staff names were documented on the LIC 811, and a copy was provided to the licensee during the inspection. According to the licensee, she does not care for her grandson; however, the infant was present during the inspection. LPA discussed documentation requirements with the licensee as there was none available for review. Licensee's Mandated Reporter Training General expires on 03/12/27; however, she is missing AB 1207. AB1207 Mandated Child Abuse Reporting \342\200\223 On or before March 30, 2018, any person who works in a child care facility shall complete the training and renew the training every 2 years. LPA also informed licensee of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Page 3 of 4 During the exit interview, the licensee Martha Huerta confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. The following deficiencies were cited in accordance with Title 22 of the California Code of Regulations and Health & Safety Codes. Please see 809D for documentation of deficiencies. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Martha Huerta. Also, LPA Veronica Martinez Garza informed the licensee to provide a copy of this licensing report dated 12/19/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Page 4 of 4
