102416.5 (e) -- Staffing Ratio and CapacityIf no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c).This requirement was not met as evidenced by On 03/08/2022 between 8:40 a.m. to 8:50 a.m. licensee was observed to operate out of ratio with one infant. Between 8:40 a.m. to 8:50 a.m. there were total of five children present with licensee, four being infants. At 8:50 a.m. licensee’s assistant arrived to the facility. This poses a potential health and safety risk to children in care.
