On January 24, 2025, at 1:45am Licensing Program Analyst (LPA) A. Carter conducted an Unannounced Annual / Random inspection and met with licensee Leticia Gutierrez . LPA disclosed the purpose of the inspection and was granted entry into the facility. Licensee was provided a copy of the Facility Entrance Checklist. All adults associated to the home were found to have criminal record clearance. There were seven (7) daycare children, and one (1) staff present during today\342\200\231s inspection. Licensee states that there are currently fourteen (14) children enrolled. LPA observed children's roster. Licensee provides care to children ages ranging from newborn to 13 years old. Licensee reports the facility\342\200\231s hours of operation are Monday through Friday from 6:00am to 4:30pm. Licensee provides transportation but does not provide overnight care. This is a single story home which consists of two (2) bedrooms, one (1) bathroom, living room, kitchen, dining room, enclosed patio (day care area), and attached garage. There is also an ADU (studio) in the backyard. Areas used by the children includes: living room, bathroom, enclosed patio, kitchen and dining room in passing. Per Licensee, areas off-limits areas includes: two (2) bedrooms, attached garage, and ADU. The licensee does understand that licensing staff may have access to off-limit areas during inspection visit if necessary. Off-limit areas are locked during operating hours, observed by LPA making them inaccessible to children in care. All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety and comfort of the children. LPA observed required posted documentation in the main care living room which included: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA observed completed facility records including: LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan and Disaster drill log, last drill conducted on 01/7/25. Smoke and carbon monoxide detector located in the main care area observed by LPA but were not tested due to children napping at the time of inspection. LPA observed the AB10BC fire extinguisher in the kitchen and in the backyard with last service date of February 17, 2024. The facility has central air and heating and maintains telephone service via cell phone. Page 2 of 4 LPA observed age appropriate toys and learning material available free of loose and sharp parts. Children have access to the hallway bathroom. LPA did not observe any hazards in the bathroom. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are locked in the hallway closet inaccessible to children in care. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. The isolation area for sick children waiting to be picked is the living room, supervised away from the other children in care . Per licensee, food is provided for children in care. LPA reminded licensee that any food brought from the children\342\200\231s homes shall be labeled with child\342\200\231s name and properly stored or refrigerated. Knives are stored in the upper cabinet next to the stove inaccessible to children in care. Per licensee, the children will have access to the backyard for outside play. LPA observed age appropriate toys such as playhouse, play kitchen, blocks, and a variety of toys for play. The play area is covered providing ample shading for children in care. LPA observed yard has grass and adequate perimeter fencing through-out the property. Play area is free of loose and sharp articles or objects and all trees, shrubs, and plants are maintained. Infant Care: Currently licensee has 2 infants under 24 months enrolled. Each infant has their own crib. Infant mattresses were observed to be firm with tightly fitted sheets. LPA did not observe loose object, bumpers, objects hanging, or objects attached to the cribs. Napping equipment does not block entrances or exits. Licensee was advised Infants shall not be swaddled in care. Car seats shall only be used for transportation purposes and shall not be used for sleeping. Overnight Care : There is no overnight care provided at the moment. LPAs discussed the following: Licensee is aware that they must remain awake while children are awake. If children sleep in separate area from licensee, the door must remain open. If licensee cannot hear children when they wake up, video or audio device can be used. Children\342\200\231s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights, and documentation of 15-minute Infant Sleep Check (0-24 months). All required licensing forms are in file. Page 3 of 4 Staff records were reviewed: Licensee's Pediatric CPR / first aid expired on 12/3/24 and the Assistant's Pediatric CPR / first aid expires on 06/14/26. Licensee had proof of required immunizations and TB clearance. Assistant was missing proof of required immunizations and TB clearance. Licensee's Mandated Reporter training was completed on 7/14/24 and Assistant's was completed on 8/28/24 valid for 2 years. All adults had LIC 508 criminal record statement on file. Assistant had LIC 9052 on file. During the inspection, children present was observed to be treated with dignity and respect, observed to be receiving safe, healthful, and comfortable accommodations, furnishings, and equipment, and free from corporal and/or unusual punishment. \302\267 Licensee stated they do not have any children that needs medication administer, or any children with allergies in care at this time. \302\267 Licensee stated that there are no smokers in the home. \302\267 Licensee stated there is a small dog in the home on occasions. LPA did not observe any pets at time of inspection. \302\267 Licensee stated there are no weapons, or firearms in the home. \302\267 Licensee stated there are no bodies of water around the premises. LPA did not observe any bodies of water at time of inspection. To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as Page 4 of 4 an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the LICENSEE Leticia Gutierrez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Leticia Gutierrez.
