What the inspector wrote

On Wednesday, March 1, 2023 at 2:28 p.m., Licensing Program Analyst (LPA) Mayra Rivera conducted an unannounced case management Lead Testing exceedance inspection. LPA Rivera met with Site Supervisor Lizbeth Aguirre who guided LPA on a tour of the facility. There were 28 children and 4 staff present during the inspection. Analyst Rivera reviewed new Assembly Bill (AB) 2370, Chapter 676, Statues of 2018, which requires the testing of for lead in Child Care Centers (CCCs) with facility Site Supervisor Lizbeth Aguirre during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1. 201, must have their water tested and post the results be January 1, 2023, and every 5 years after the sate of the first testing. Facility provided a copy of the report that covers the analysis performed on samples submitted to LA Testing on 2/3/2023. On 2/15/23, the department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples collected on 2/3/2023. Faucets reported with 6.61 and 6.53 ppb or greater lead exceedance levels as follows: Room One -Sink faucet lead result of 6.61 and Room Two Sink faucet lead result 6.53 Site supervisor Lizbeth Aguirre informed LPA Rivera that the sink in room 2 has not been used due to the room not being occupied. She also indicated that the faucets have been retested and are still showing signs of execeedance. Lizbeth stated the faucets were being flushed 4 times a day for 3 weeks per tester Spencer. Spencer gave the facility a schedule for flushing. The plan is now to add a water filter to the sinks and retest. LPA Rivera observed sink area/faucets covered with plastic bag and a sign that says "out of order and do not use." The sink area is inaccessible to staff and children. Site supervisor Lizbeth stated children drink water from a water dispenser and the items such as fruit and veggies are washed in the kitchen (which was tested and have passing water levels). At approximately 2:55 p.m., LPA Rivera took pictures of the water faucets sink area (room 1 and 2). A deficiency was cited to ensure that the water fixture noted will not be used as a drinking source or food preparation source for children. The deficiency listed on the following page was observed by the LPA and is being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809-D. The deficiency being cited needs to be cleared to protect the children\342\200\231s health & safety. Site Supervisor Lizbeth exhibited to LPA that the water source is not in use and submitted a plan of correction during todays visit. The Notice of Site Visit (LIC 9213 \342\200\223must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00 . Exit interview conducted with Site Supervisor Lizbeth Aguirre and a copy of Appeal Rights (LIC 9058) was discussed.
