What the inspector wrote

On 7/19/2023 at 9:30 am, Licensing Program Analyst (LPA) Carolyn Tuba conducted an unannounced case management inspection. LPA met with Andrea Uribe, Site director who provided a tour of the facility to gain the census. There were 10 children and 5 staff present during the inspection. During the inspection Site Director called Education Coordinator, Vinia Casuga who met LPA at the facility at approximately 10:30 am. The purpose of today's inspection is to go over the water lead test results received on 07/05/2023. Results indicate that the water fountain labeled (L) water sources had action level exceedance of lead. The water fountain located in portable #5 had a lead result of 14. LPA observed that faucets are not accessible through signage and with a cover that is inaccessible to children in care. The water fountain located in the portable #5 has been fixed according to both Site Director and Education Coordinator but require that it be tested again. During the visit LPA was told by the Education Coordinator and Site Director that portable classroom was not part of the infant license and LPA determined that the portable belonged to the Options State Preschool -La Seda facility #191500870, which is a closed facility and has not operated since October of 2015. However even though children do not use LPA was told that staff do use for their breaks time and portable #5 was included as part of the lead testing. LPA took pictures of the water fountain during the inspection. A deficiency was cited to ensure that the faucet will be retested since it has already been fixed by replacing water fixture. Facility Coordinator, Andrea Butler had emailed LPA prior to the inspection the following reports, LIC 9275, LIC 9276, facility sketches and testing results of the facility. LPA provided the PIN 21-21.1 CCP Lead. The deficiency listed on the following page were observed by the LPA and is being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809-D. The deficiency that is being cited needs to be cleared to protect the children\342\200\231s health & safety. Exit interview conducted and a copy of this report, along with appeals rights was reviewed with the Education Coordinator, Vinia Casuga. A notice of site visit was given and must remain posted for 30 days.

    (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. This requirement was not met as evidence by record review. Lead test results showed that one water source had an action level exceedance. LPA observed drinking fountain in portable #5 to be made inaccessible with a cover and photos were taken during the inspection. This is a potential risk to the health and safety of the children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections....... This requirement is not met as evidenced by: Based on interviews, the child wandered away from the facility unsupervised for at least 5 minutes with no adult supervision. This poses an immediate Health and Safety risk to children in care.
