Inspector’s narrative

What the inspector wrote

they \342\200\234would bring a mat to the classroom, but kids don\342\200\231t sleep\342\200\235, therefore children are not provided with napping equipment. Interviews conducted with children, staff, and the Administrator corroborate the above allegation that the facility is operating over ratio. While interviewing staff, it was said that children from the school age program are sent to the preschool program when the teacher-child ratio is not in compliance with Title 22, Division 12, Chapter 1 regulations. Per Administrator school age children are sent to the preschool classrooms when there are \342\200\234more kids than expected\342\200\235 in the school age classroom. Administrator states that if the school age child is in the \342\200\234preschool age group they will be able to be transferred to the preschool classroom\342\200\235. LPA did not find evidence that additional staff are brought in when the teacher-child ratio is out of ratio. Based on LPAs interviews conducted and observations made, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22, Division 12, Chapter number 1) are being cited on the attached LIC 9099D. The Administrator was provided with LIC 9224 Parent Acknowledgement of Report Received. A copy of this report shall also be posted where the parent/guardian of children enter and exit the facility. Both the notice of site visit and licensing report shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon their return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled child for the next 12 months. A signed Acknowledgement of Receipt (LIC 9224) shall be in each child\342\200\231s file, acknowledging receipt. An exit interview was conducted and report was reviewed with the Director. Appeal rights were discussed and proved to the Administrator.

This requirement is not met as evidenced by: Based on interviews and observations conducted, the Licensee did not ensure that children are provided with appropriate sleeping equipment by having children sleep with their heads on the table. This is a potential health, safety or personal rights risk to persons in care.

    101516.5 Teacher-child Ratio (b) There shall be a staffing ratio of one teacher and one aide present to every 28 children in attendance. (1) A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children. This requirement was not met as evidenced by: Based on interviews conducted, the Licensee did not ensure that the teacher-child ratio was in compliance with Title 22, Division 12, Chapter 1 regulations. This is a immediate risk to the health and safety of the children in care.
