LIMITATIONS ON CAPACITY
101161 Limitations on Capacity (a)A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: Based on interviews conducted, the Licensee states that children between the preschool program and school age program are co-mingled. This is a immediate risk to the health and safety of the children in care.

101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interviews and observations conducted, the Licensee did not ensure that children are provided with appropriate sleeping equipment by having children sleep with their heads on the table. This is a potential health, safety or personal rights risk to persons in care.
