What the inspector wrote

Information from the complainant indicates that medications are improperly stored. Staff were reported as operating out of ratio and not providing adequate supervision. The Report states that staff are using personal cell phones while in the presence of children in care. During interview with Director, Director states that medications are kept in the office in a big cabinet, high up so that they are not accessible to children. LPAs did not observe any medication in classrooms accessible to children. On 02/11/2022, Licensing staff obtained a blank copy of the facility Medical Release Form that requires the Name of Child, Medication, Times to take it at Preschool, Dosage, and a log section for Date, Time, and Person administering medication. During today’s inspection, LPA asked Director to describe the medication intake and log procedures, to which they explained the Medical Release Form and that they store it for the children.. Director has stated that the ratio for the preschool is 1 teacher to 12 children in care and that the ratio for infants is 1 teacher to 4 children. During the tour of facility on 02/11/2022 and today, Licensing staff observed all teacher-child ratios to be in compliance with Title 22 regulations. During interview regarding personal cell phone usage, Director disclosed that they have not had a cell phone issue with staff in months, but there is a precedent. Director was asked how often administration observes each classroom. They stated multiple times a day. LPA recommended Director to continue observation of classrooms and to instruct facility staff to keep personal cell phones not on their body and to follow the policy noted in the Policy and Procedure Manual that states, “No cellular phones are allowed to be used in the classroom at any time.” Any emergency calls or calls aware of in advance, should go through the facility office phone line. Staff interviews corroborated Directors statements regarding medication. Per Staff #3-6, medications are not kept in the classroom. Additional Staff interviews state that medication that is required and signed in would can be kept in the classroom but they would be in a cabinet out of reach. There are no current children who are requiring medication. Staff interviews also disclosed that though there are no cell phone usage in the classroom, personal cell phones are typically kept with the staff in their classrooms. Staff stated they keep their phone in their purse, cabinet, and cubbies. All staff understood that they were to not use phones in class. LPAs did not observe personal cell phone usage during tours of facility. All staff were visibly observing children in care. Parent interviews made disclosures regarding the above allegations. REPORT CONTINUES PAGE 2 of 3 Based upon the evidence as presented above, this agency has investigated the allegation above and has determined that the allegation is Unsubstantiated. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated. No deficiencies are being cited for the allegations listed above The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Exit interview was conducted with Licensee Doris Alvarez, at 9:50am, including a copy of the report. END OF REPORT PAGE 3 of 3
