What the inspector wrote

Licensing Program Analysts (LPAs) Nolan Tcheng and Lilli Babcock conducted an unannounced in-person Case Management-Deficiencies inspection. Upon arrival at 12:35 pm, LPAs met with Director Ann Davis, to whom the purpose of the visit was explained. At 12:45 pm, LPAs were given a tour of the facility where there were children present at the time of inspection. Census was taken. There were 2 Staff and 4 Children in Infant Room 0-12 months, 3 Staff and 7 Children in Infant Room (14A) One Year Olds, and 2 Staff and 6 Children in Infant Room (14B) 1.5 Year Olds. During the walk-through of the facility, LPAs observed that Infant Teacher, Priscilla Sanchez was not on the Licensing Information System (LIS) facility roster. LPA Babcock contacted the Monterey Park Regional Office and spoke with Office Assistant (OA) Chris Gomez via telephone who confirmed that the Guardian Website shows Priscilla Sanchez having clearance status as "Eligible", however is not associated with facility number 198015866. Staff #1 stated they thought Priscilla Sanchez had been associated to the facility through the Agency database of Guardian, however upon further review realized it had not been completed. LPA conducted a file review and observed that all necessary documents for associating staff fingerprints are present in Priscilla Sanchez's staff file. File indicates the employee start date of Priscilla Sanchez to be 8/23/21. LPAs discussed with Director the importance of having adults associated to the facility prior to their start date on the property with children. The Department's Guardian system was discussed and facility is already attempting to utilize the system. An immediate civil penalty in the amount of $500 is being assessed. The civil penalty being assessed, including the authority for the citation and the amount assessed is attached on form LIC 421BG. Report Continues, Page 1 of 2 The deficiencies listed on the following pages were observed by the LPAs and are being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809D for deficiencies that are being cited and need to be cleared to protect the children’s health & safety. Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. This requirement was not met as evidenced by: Based on observation and file review, Licensee did not ensure that Priscilla Sanchez had her criminal background clearance associated to the facility prior to working as of 8/23/21. This poses a potential risk to the health, safety, and personal rights of children in care.
