What the inspector wrote

Allegation: Staff restrained infant in care The complaint alleges children are frequently buckled into an activity chair watching television for 30 minutes. Complaint alleges during this time the children are not eating or doing an activity at the table. Complainant stated parents ring the doorbell to pick up their children and staff then bring the child out to the parent. Complainant stated they started walking into the classroom to pick up their child instead of ringing the doorbell and parent observed their child in the chair watching television and staff were cleaning the classroom. Complainant stated they asked a staff member how long the child had been in the chair watching television and staff stated the child had been watching television in the chair for 30 minutes. During interviews conducted, Staff #1 stated they observed children in the activity chair while watching television "during tv time which is during lunch preparing and cleaning. One teacher is preparing lunches in the same room and the other teacher is changing diapers and cleaning the kids up". Staff #1 stated this is for a duration of 15 minutes and there are no other activities on the table, and the children are watching television during this time. Staff #4 stated, "We put them in when we are getting ready for lunch and we have the tv on because one person is preparing lunches and the other 2 are changing diapers and cleaning them up for lunch. It's usually only for 15-20 minutes depending on how many kids we have. For a full class its 15-20 minutes". Staff #6 stated children are in the activity chairs and "they put the tv on while they are preparing the lunches. In the morning they don't interact with the kids and they put the tv on. I don't agree with that". Staff #7 stated "they are in the chair buckled in while we are preparing lunch and snacks and I am getting their bibs on and getting their water ready". Staff #7 stated this is for a duration of 15 minutes. Staff #8 stated, "children are buckled into the activity chair to watch TV when they are getting ready for lunch. TV is only supposed to be when they are preparing something". Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D. Page 2 of 3 Allegation #1: Staff handled infant in care in a rough manner The complaint alleges that a child in care was handled in a rough manner. During interviews conducted, all staff stated they have never heard of or observed any staff handling an infant in a rough manner. All parents interviewed stated they are satisfied with the care, supervision, and treatment of their child while at Lad N Lassie. Allegation #2: Infant in care sustained unexplained injuries due to staff neglect/lack of supervision The complaint alleges that a child in care experienced unexplained injuries including bites, scratches, open wounds, bruises, and facial swelling at the facility and believes their child received injuries due to lack of supervision by staff. Complaint states biting continued for over a year and staff could not provide an adequate explanation of why they were not able to stop their child from being bitten. LPA Babcock conducted interviews with staff, parents, and children at the facility. During interviews conducted all staff stated the facility procedure for biting is to fill out a biting report for the child that bit another child, and an ouch report for the child that was bit. Staff stated the facility has a biting policy which states "if a child is biting consistently for more than 2 weeks (or 3 incidents within a week) the parents will be asked for support at home to help end the biting. If the situation doesn't improve immediately, a parent conference will be scheduled. If the parents of the biter do not support the conference, the child will be disenrolled from the program." All staff stated they abide by the biting policy. LPA reviewed children's files and did not observe any children who were biting others for over a year, and did observe files with signed biting policy forms for children who experience biting other children in care. LPA observed the facility appears to be following their biting policy. All staff interviewed stated they provide visual supervision of children in care at all times. Parents interviewed stated they were satisfied with the care, supervision, and treatment of their child at Lad N Lassie. Page 2 of 4 Allegation #3: Staff did not administered medication to infant in care Complaint alleges staff reported to parent that teething medication was given to a child, but parent does not think the medication was given to the infant. During interviews conducted, all staff stated they note on the Daily Report when medication is given to a child and all staff stated there has never been a time when a parent was told a medication was given and it was not give to the child. All parents interviewed stated when they provide medication to the daycare for their child, they are satisfied with the way the daycare administers the medication to their child. Complaint also expressed concerns about lack of outdoor play/physical activity and stated that children were not taken outside even though weather permitted. During interviews conducted, all staff stated children are always taken outdoors unless weather does not permit outside play. Complaint also expressed concern that parent was told their child ate their lunch when they had not, parent was not notified of a party and their child had eaten food during a party without parent consent. During interviews conducted, all staff stated there has never been a time that a child was given food from a party or through other means without parent consent. Staff stated parents are notified how much food their child has eaten on the Daily Report given to parents at the end of the day. All staff stated parents are notified of a party ahead of time. All parents interviewed stated they are notified by the facility if there will be a party for their childs classroom or that Lad N Lassie will be providing food for children to eat. All parent interviewed stated they are always notified of what food will be provided and the ability to let the facility know if parents do not want their child to eat the food that will be provided for the party or other occasion. Complaint also expressed concern regarding picking up their child with dirty hands, face, and clothing. Staff interviewed stated children's hands are washed throughout the day, before and after meals, after outdoor play, if staff see they are dirty, or prior to going home. Parents interviewed stated they do not have any concerns with their child’s hands, face, or clothing being dirty while at the facility. LPA Babcock did not observe children's Page 3 of 4 hands, faces, and clothing to be dirty during complaint inspection visits on 1/30/26, 2/5/26, 4/22/26, and 4/23/26. Children interviewed stated they wash their hands before and after they eat and after outside play. Complaint also expressed concern with staff telling the children shaming phrases or gestures during diaper changes or toileting, such as "stinky", and making gagging sounds. This concern was addressed on a case management report dated 4/23/26. Technical Support Program was offered to facility and accepted by Director. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Office Administrator, Melissa Rojas.
