What the inspector wrote

Interviews with staff were conducted on 06/13/2024, regarding rough handling of a child in care. Per Staff #2 (S2), Staff #4 (S4) takes the kids by their hand instead of letting them do it on their own. S2 states “they will just take their hands and stop their activity…” and that when it comes to wiping a child’s nose, S4 will come up behind the child a “just rub their faces with tissue” instead of letting them know or giving them warning. Staff #3 (S3) states “I have witnessed, twice, one of the kids was by the door and S4 picked [them] up roughly and set them down…another time was a child crying, and S4 picked them up during potty training and placed them on the ground while S4 was taking their clothes off.” Staff #5 states that S4 forced a child to give up a toy. Staff #6 (S6) was asked regarding observing any rough handling of children at the facility and stated, “I did right now… but they grabbed a child by the arm and told them to go line up.” Interviews with staff were conducted on 06/12/2024, regarding inappropriate behavior being displayed in front of children in care. Staff #5 (S5) stated during interview, that S4 was stressed out and refused to read to the children, and that they snapped at one of the other teachers. S4 responded in a rude way to the other teacher but in front of the children. S6 states “Mainly their tone, it seems to make the kids uncomfortable. They don’t say anything vulgar or profanity. They say ‘You need to sit down!’ ‘You need to stay there!’ Rather than talking to the child.” Based on LPAs observations and interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 Chapter 1 Section 101223(a)(1) , is being cited on the attached deficiencies page. Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Assistant Director Leticia Larios, at 11:45am. Plan of corrrections developed and copy of Report provided. END OF REPORT PAGE 2 of 2 Licensing staff spoke with staff regarding the sanitation practices at the facility and how staff spoke with children in care. Interviews with staff made no disclosures regarding the above allegations Interview with parents made no disclosures regarding the above allegations. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Assistant Director Leticia Larios, at 11:45am. Copy of Report provided.
