What the inspector wrote

Page 2 Per interviews there were no disclosures or collaborating statements or witnesses to any child being handle in a rough manner by any staff member. No child had been hit on the head by any door. Staff encouraged day-care child to hit another child. Per complainant, a staff member had encourage a student to hit a special needs student. The special needs child has tendencies to hit and push other students, he went to hit another child and rather than the staff member distracting the child, she encouraged the child to hit the special needs child. Per interviews and declarations there were no disclosures or collaborating statements or witnesses to any staff encouraging any chid to hit another child. The staff states they teach children to use their words and no hitting or fighting. Staff took unauthorized photo of day-care child and Staff humiliated day-care child. Per complainant, Staff member took pictures of a little boy in a dress and had shown other teachers as a form of humiliation. Per interviews and written declarations it was stated that the child had wet himself and the only spare clothes available was a girls dress and little boys underwear, this was to prevent him from being naked and called mom for spare clothes. It was also stated that the child was not in a dress but a T-shirt and under wear. Per interviews there were no disclosures or collaborating statements or witnesses to these allegations. Staff discarded day-care child's food. Complainant alleged that a child was playing with her food and a staff member threw her full plate of food away. It was stated that the child takes a long time to eat and the children are taught to throw there own food away if they are done eating unless they ask for help. The staff will let the child sit and eat even while the other children are cleaning up and getting ready for nap time. There were no disclosures or collaborating statements or witnesses to any of the above allegations or incidents occurring. Based on interviews, and records reviewed and received, the above allegations are deemed UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred. An exit interview was conducted, and a copy of this report was provided to Licensee/Director Beth Holmes , and the Notice of Site Visit and Appeal Rights. Page 2 The following deficiency(s) listed on the attached LIC 9099D (deficiency page) is being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safe. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Licensee/director Beth Holmes . Type A citation LPA Reyes informed Licensee that this report dated 09/17/2024 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Reyes informed the Licensee, to provide a copy of this licensing report dated 09/17/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This requirement is not met as evidence by staff member stated she told the child to choose a play center to go to or she will remove the stamp for listening by the count of 3. This poses an immediate risk to the health and safety of children in care.
