What the inspector wrote

Based on LPAs observations of the declarations obtained and interviews which were conducted, the preponderance of the evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1 (FCC) 102417(a) are being cited on the attached LIC9099D. Exit interview was conducted with Licensee, Maria Gutierrez, including, but not limited to Appeal Procedures, Site Visit and Initial Appeal Rights in Spanish.

    102417 Operation of a Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. ..This requirement is not met as evidenced by: Based on interviews conducted, of the seven children in care and under the supervision of the Licensee and their assistant one child was able to wander away from the facility and not known for approximately 15 minutes. The child was able to wonder 655 feet from the facility and was returned by a neighbor. This poses an immediate health, safety, or personal rights risk to persons in care. An immediate civil penalty in the amount of $500 is being accessed.
