What the inspector wrote

On 9/28/23 Licensing Program Analyst (LPA) Jeanette Estrada conducted an unannounced required 1 year inspection at the above facility. LPA met with the Licensee Maria Cortez and informed her of the purpose for the visit. LPA provided Licensee with a copy of the Facility Entrance Checklist. There were 6 children and one assistant present during the inspection. All residents were noted and verified. Facility provides care to children ages 3 months to 12 years. Facility is open Monday to Friday 6:30 AM to 6:00 PM. This is a one story, 3 bedroom, 2 bathroom home. Per Licensee areas on limits to children are: Day care room next to kitchen, bathroom in the day care room and the fenced backyard. Currently children access the day care room through the main entrance of the home. At this time, the living room, dining area and kitchen are on limits. Once renovation is completed in the home, children will return to enter the day care classroom through the backyard. Per Licensee areas off limits to children are: 3 bedrooms, one bathroom, laundry room, ADU and a section of the backyard separated by a gate. Once renovations are complete, the living room, dining area and kitchen will be off limits. All areas that are accessible to children were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: LPA observed required posted documentation in the day care room: Facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA observed and reviewed a current roster LIC 9040 and a current disaster drill log. Last disaster drill was performed in August 2023. LPA observed a smoke detector in the day care room and carbon monoxide detector in the kitchen. During the visit LPA did not test devices due to children sleeping . Licensee will send video proof of functioning devices. LPA observed a 2A10BC Fire Extinguisher in the daycare room which indicated full and was last serviced October 2022. The home maintains telephone service (cell phone). Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child\342\200\231s name and properly stored or refrigerated. There are toys and other age appropriate materials available for children to use in the day care room and in the backyard. Sharp objects, detergents and cleaning compounds were inaccessible to children in care. Knives are kept in an upper kitchen cabinet, Cleaning products are in an upper cabinet in the laundry room, detergent is in the laundry room-Laundry room is inaccessible via a gate. Page 2 Per Licensee, personal medicine is kept in the ADU and in the off limits bathroom. Per Licensee, no children enrolled require medication. The facility has central air and heating. There were no fireplaces observed. Children nap in the day care room and they are provided appropriate napping equipment. Children use the restroom in day care room. LPA did not observe any cleaning products or medicine in the on limits bathroom. LPA observed personal items in the cabinets. Children use the backyard for outdoor play. At the time of this visit, the fencing was being renovated. Per Licensee, children will return to playing outside once renovations are completed. Per Licensee, outdoor play area will be fully fenced. Per Licensee, children are supervised while playing outside. Per Licensee, there are no poisons in the home. Licensee understands that all poisons must be locked, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in a section of the day care room, separated from other children. Per Licensee, there are no firearms or weapons stored in the home. LPA did not observe any pools or spas, or other bodies of water. There is one pet dog in the home. The dog is contained in an off limits area of the backyard that is separated by another gate. Infant Care: Currently licensee has 2 infants enrolled. One infant under 12 months old naps in a play yard and the other infant over 12 months old naps on a mat. LPA observed one infant napping in the play yard. LPA observed that the play yard does not block any entrances or exits and LPA did not observe any items in the crib. Licensee was advised Infants shall not be swaddled in care. Car seats shall not be used for sleeping. LPA observed the 15 minute sleeping log for both infants and LIC 9227 on file for infant under 12 months old. Overnight Care: There is no overnight care provided at the moment. LPA discussed the following: Licensee is aware that they must remain awake while children are awake. If children sleep in separate area from licensee, the door must remain open. If licensee cannot hear children when they wake up, video or audio device can be used. Children's records were reviewed: Children's records contained (LIC) 282- Affidavit Regarding Liability Insurance, Immunization Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights, 15 minute infant sleep log and LIC 9227. Staff records were reviewed: Licensee's pediatric CPR/First Aid was completed on 11/29/22, Assistant's pediatric cpr/first was completed on 5/5/23. Staff had proof of required immunizations (measles, pertussis, flu-declination on file for Licensee and assistant). Staff had proof of TB clearance. Licensee's Mandated Reporter training was completed in 8/27/23. Assistant's Mandated Reporter training was completed on 5/4/23. LIC 508, LIC 9108 and LIC 9052 were on file. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the Licensee Maria Cortez , confirmed that there are no Registered Sex Offenders living in the facility. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee, Maria Cortez.
