What the inspector wrote

On August 8, 2024, at 11:00AM Licensing Program Analyst (LPAs) A. Carter and T. Tran conducted an Unannounced Required Annual Inspection and met with Licensee Francis Toma s . LPAs disclosed the purpose of the inspection and was granted entry into the facility. All adults associated to the home were found to have criminal record clearance. Also present was Sandra Padilla, Licensee’s Assistant. There were four (4) daycare children present during today’s inspection. Licensee states that there are currently thirteen (13) children enrolled. Per Licensee the hours of operation are 24 hours 7 days a week. Currently children are in care from 7:30am-12:30am Monday - Sunday. LPA discussed with Licensee overnight care regulations. Care provided during the day and overnight combined shall not exceed 24 hours from the time the child entered into care. The Parent Board had the following documents posted: · License · Parent's Rights · Earthquake Preparedness · Emergency Disaster Plan Licensee does not have a Disaster Drill log. LPAs informed licensee of the importance of conducting emergency drills and provided the licensee with a log to use. The valve on the required 2A 10BC fire extinguisher indicates fully charged. LPAs observed smoke and carbon monoxide detectors are in operable condition. The Licensee has current Pediatric First Aid and CPR valid until 05/20/25. Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. The Licensee has also taken the Mandated Reporter Training Completed: 07/22/24 (licensee).Childrens' files were reviewed. LPAs observed C1 and C4 to be missing immunization records. This is a single story home which consists of 3 bedrooms, 2 1/2 bathrooms, living room, kitchen, and a detached garage converted into storage room. Childcare is mainly conducted in the living room. Children in care will have access to living room, and half bathroom. There is a safety gate blocking access to the kitchen making it inaccessible to children in care. Per licensee, they provide food for children in care. Per licensee the sick/isolation area is the couch in the living room. At 11:15am all areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. There is a working telephone maintained in the home. LPAs observed age appropriate toys, free of loose and sharp parts. LPA observed electrical cover outlets all through the home. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked. Per licensee, the children will have access to enclosed front yard area. LPAs observed adequate perimeter fencing through-out the yard. LPAs observed age appropriate toys free of loose and sharp parts available for the children in the front yard and all trees, shrubs, and plants are maintained. LPAs advised licensee that outdoor supervision is required. LPAs did not observe any pets at time of inspection and Licensee confirms she has no pets. Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPAs did not observe any bodies of water on the premises. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee, Francis Tomas , confirmed that there are no Registered Sex Offenders living in the facility and LPAs completed the RSO profile in FAS. Type B deficiencies were cited during today's visit. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee , Francis Tomas.
