Regarding the allegation that staff restrain infants: LPA conducted interviews with staff and complainant. Staff disclosures were consistent in the procedures of feeding infants in high chairs and putting infants down in cribs for napping. Complainant #2’s statements were inconsistent with Staff disclosures in that infants are kept in cribs and highchairs for “up to 3 hours”. This agency has investigated the complaint alleging that staff restrain infants. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegations are unsubstantiated. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
