What the inspector wrote

Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Annual/Random inspection at the above facility on 05/07/26 at 11:30 a.m. At approx. 11:34 a.m., LPA met with licensee Kelley Lam who guided LPA on a tour of the facility. There were 3 children present in the home. According to the licensee, 11 children are enrolled; however, some are school age children and arrive after school or their schedules varies. Operation hours are Monday – Sunday 09:00 a.m. – 08:00 p.m. This is a one-story home which consists of 3 bedrooms, 2 bathrooms, living room, dining room, kitchen, garage, and back patio. According to the licensee, children use the living room, dining room, kitchen, and 1 bathroom. Family members residing in the home are 2 adults and 0 minors. According to the licensee, there are 2 cats on the premises. LPA toured all areas identified on the facility sketch used by children during this visit and were inspected for safety, comfort, and cleanliness. Tour began in the living room where LPA observed furniture, age appropriate toys, materials, (1) play pen, and cots for children. The majority of the living room is covered in puzzle floor mats and there is also an empty/sealed fireplace. Tour continued to the kitchen where LPA observed child proof locks on the kitchen cabinets. LPA then toured the dining room where LPA observed it was converted into an activity room. LPA observed the dining room has age appropriate toys and materials for children. The majority of the dining room is also covered in puzzle floor mats. Per licensee, children do not use the back patio for outdoor play. LPA observed that the sliding door in the kitchen/dining room leading to the back patio was locked/closed. Licensee then guided analyst to the children’s bathroom which is located down the hallway from the living room and kitchen. LPA observed that the children’s bathroom is safe and in sanitary conditions. Licensee maintains all off-limit areas inaccessible to children. Page 1 of 3 At 11:39 a.m., smoke and carbon monoxide detectors were observed to be operable. The valve on the required 3A40BC fire extinguisher indicates fully charged and was serviced on 10/07/24, per the attached service tag. The licensee has a first aid kit readily available. LPA observed the following required posted documentation in the dining room: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form, LIC 610- Emergency Disaster Plan and PUB 269 California Child Passenger Safety Law. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill conducted was on 12/2025. Children’s roster was available for review during the inspection. Per licensee, food is provided by parents. Licensee was advised that food/containers brought from the children’s homes, must be labeled with the child’s name and properly stored or refrigerated. The facility has a working telephone, ventilation, and heating. Detergents, cleaning compounds, medications, and other items which could pose a danger to children were observed to be inaccessible to children. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. Per the licensee, there are no firearms, weapons or bodies of water in the home. Children and staff records were reviewed . LPA observed 1 out of 5 children’s files did not have a sleep log. According to the licensee, the infant sleeps approx. 30 mins or rarely sleeps. LPA provided consultation and a technical violation. Children and staff names were documented on the LIC 811, and a copy was provided to the licensee during the inspection. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Page 2 of 3 AB1207 Mandated Child Abuse Reporting – On or before March 30, 2018, any person who works in a child care facility shall complete the training and renew the training every 2 years. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee Kelley Lam confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. The following deficiencies were cited in accordance with Title 22 of the California Code of Regulations and Health & Safety Codes. Please see 809D for documentation of deficiencies. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Kelley Lam.
