What the inspector wrote

On November 26, 2024, at 11:25 AM Licensing Program Analysts (LPA) Priscilla Ochoa conducted an unannounced annual inspection at the above facility. LPA was greeted by licensee, Angela Neumeier who guided LPA on a tour of the facility. Licensee\342\200\231s assistant was also present during the inspection. At 11:30 AM, LPA observed a speech therapist partake in a session with a daycare child. Licensee\342\200\231s husband also joined the inspection at 12:00 PM. Per licensee 14 children are enrolled and LPA observed 14 children in care. Hours of operation are Monday through Friday, 8:00 AM to 5:00 PM. Family members residing in the home: 2 adult who has criminal record clearance and licensee\342\200\231s 3 minor children. This is a two-story home which consists of 4 bedrooms, 4 bathrooms, kitchen, dining room, living room, rear room (Art Room), backyard (fenced), and Guest house (classroom) that is located in the backyard. Areas accessible to children in the home are the living room for nap time and rear room, which is the Art Room. Other areas accessible are the Guest house, which is the main childcare room, the bathroom in the guest house and back yard which is fenced. Off limit areas include 3 bedrooms, 3 bathrooms, kitchen, and dining room. LPA observed one large dog during the inspection. LPA asked licensee to place dog in an inaccessible area while conduction inspection. At 11:40 AM, licensee guided LPA on a tour of the areas that are accessible to the children in care. Per licensee, parents enter through back gate of the backyard which is double fenced through Franklin St. LPA observed the back yard to be large with ample space and several age-appropriate toys available for children in care. LPA also observed playhouses and mini apparatus along with a sandbox. Per licensee the sand box is racked every week and covered every night with a brown tarp. The sandbox is also inspected every morning before use. LPA then inspected the guest house where more age \342\200\223 appropriate toys were observed. Children in care use the restroom that is located in the guest house, which was clean and orderly. No items were found that can pose a risk to children in care. Page 1 of 4 There is another fenced section of the backyard that has a swimming pool. The pool is located adjacent to the house and accessed through the back yard. There is a self-latching gate that opens away from the pool. The gate's latch is no more than 6 inches from the top of the gate and has a lock on it. The gate is constructed not obscure the pool from view and is strong enough to withstand force against it. Each vertical railing of the gate is no more than 4in apart and the bottom of the gate is no more than 4in from the ground. Per licensee, the pool is used only during summer and when Licensee\342\200\231s husband, who is certified swim instructor is present. The licensee is observed to be operating within the license capacity limitations. LPA then toured the Art room which is located in the main house along with living room. The Art room was observed to be free of hazards. LPA then inspected the living room that is used as a napping area. LPA observed napping equipment in the form of cots and bedding was inspected for good condition, appropriate storage, and cleanliness. Per licensee, sheets are washed at the facilities weekly. A fireplace was observed in the living room and made inaccessible to prevent access by children. There is a child safety gate which keeps stairs inaccessible to children. All areas were observed to be clean, orderly, comfortable, and well ventilated. Per licensee, the art room is used as an isolation area when a child falls ill. A cot is provided if needed for child in care. Licensee's poisons, detergent, cleaning compounds, medications and other items which could pose a danger to child are stored where they are inaccessible to children. LPA did observe a working smoke / carbon monoxide detector. Two 2A-10BC fire extinguisher were observed. One fire extinguisher in the Art Room and another in the guest house. Both fire extinguishers were serviced on 8/08/2024. There is a working telephone on site. Per the licensee, there are no firearms on the premises. Licensee Staff 2(S2) has current Pediatric First Aid and CPR, expires 11/06/2025. LPA reviewed children files; files were found to be complete. LPA observed a child present that is not enrolled in the program. Per licensee, since the child has a sibling already in the daycare, she allowed the child to participate for fun just for today. Child\342\200\231s parent did come by and pick up the child. LPA advised licensee that is best practice to only have children participate only if they are enrolled in the program. Licensee received a technical violation. LPA reviewed staff files: files were found to be incomplete. Staff1 (S1) \342\200\223 Staff3 (S3) have an expired Mandated Reporter training certificate. Children and staff names were documented on LIC811 (confidential page). Page 2 of 4 All childcare employees must complete mandated reporter training www.mandatedreporterca.com , within 30 days of hire and renew training every two years. Per the licensee, fire and disaster drills are conducted every 6 months; last drill documented and conducted on 11/20/2024. Licensee has the required documents posted in the FCCH; Facility License (LIC 203), Emergency Disaster Plan (LIC610a), Notification of Parents' Rights Poster (PUB 394). Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B. The on Duty Worker is available for questions Monday through Friday at (323) 981-3350 from 8:00 AM - 5:00 PM. The licensee was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hot-line at 1-800-540-4000. Also call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B). The licensee was informed that the presence of adults in the home without Criminal Record Clearance or Exemption will be cited and civil penalty assessed for $100 per day. The licensee may find additional information and forms on the DSS website at www.ccld.ca.gov including information on the Live Scan application (LIC 9163). Appointments can be made for Live Scan at 1-800-315-4507 The following was discussed with the licensee: Capacity requirements, Roster requirements, Posting requirements, Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children\342\200\231s files and provider\342\200\231s files, and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. Licensee was reminded that supervision is always required to children in care. Page 3 of 4 Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility\342\200\231s phone number; if the phone number is changed, licensing must be notified. Regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family day care home where children are present (24/7 ban). State law prohibits baby walkers, bouncy seats, exersaucers and any other items that fall into that category. --Licensee was advised to visit the CCL website ( www.ccld.ca.gov ) to obtain updates of courses and updates/changes to the regulations. -- Our Quarterly updates come out every 3 months they are also now in Spanish please log in to the CCLD website or you can email our advocates to have the quarterly updates send directly to your email. Child Care Advocates information: www.childcareadvocatesprogram@cdss.ca.gov LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. The licensee, Angela Neumeier confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA provided consultation during inspection. Based on the LPA\342\200\231s observations and record review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety. A notice of site visit was given and must remain posted for 30 days during facility\342\200\231s hours of operation. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted, and a copy of the report was provided, along with appeal rights to licensee Angela Neumeier. Page 4 of 4
