What the inspector wrote

On 05/31/2023, at 9:40 AM, Licensing Program Analyst (LPA) Mary Silva and Lilli Babcock conducted an unannounced case management lead testing exceedance inspection for an Action Level Exceedance (ALE) detected in two water fixtures in the facility. LPA(s) were greeted by Karen Gutierrez lead teacher and was informed Barbara Schumacher Education Coordinator would be arriving soon. At approximately 10:10am Barbara Schumacher arrived and conducted a tour of the facility. Also present in the facility were 2 daycare children and 3 teachers/staff. Facility was within ratio & capacity. A COVID 19 risk assessment was conducted prior to entering the facility and appropriate Personal Protective Equipment was worn by LPA(s). Analysts reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with Lead Teacher during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided facility sketch, although all outlets tested were not properly labeled. In addition, required forms LIC 9276, and LIC 9275 have not been submitted to LPA as of this date. On 05/19/2023, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 05/06/2023. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows: Sample Site A – Sink Faucet in Room 2 (6.50 UG/L) – Faucet currently not in use. Sample Site D – Sink Faucet in Room 4 (5.50 UG/L) – Faucet currently not in use. Page 1 of 2 Barbara Schumacher, Education Coordinator stated the facility has not used the faucets in Room 2 and Room 4 for drinking prior to Covid before 2020. Children have been drinking water from the Britta filter in disposable cups. The facility has put an "out of service" sign on and around the faucets A & D and made them further inaccessible by attaching a red cap securing around the faucets. Barbara Schumacher stated, the facility program director will make a final decision to have the outlets A & D removed or replaced and retested. LPA(s) observed an additional bubbler located in the courtyard on the wall leading to the staff lounge/office. Per Educational Coordinator, the bubbler will be removed or tested by 6/30/2023. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP.
