At 11:40 am Licensing Program Analysts (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. LPA had attempted a visit to this facility on 6/18/21. A precautionary COVID assessment was conducted. On this date, LPA met with Jaqueline Tovar, Licensee who guided analysts on a tour of the facility. Per Licensee, there are 12 children that are currently enrolled, however she has not had any children in care since COVID. Per Licensee, she currently does pick up and drop off for school but is not caring for children in her home. A current children’s roster was available for review. There were 0 children present upon arrival. The licensee states that 1 adult and 0 children currently live in the home. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home. Licensee states that there are no firearms stored in the home. This is a two story home which consists of 4 bedrooms, 3 bathrooms, kitchen, living room, day care room, garage, front and backyard (fenced). The children have access to day care room, one bathroom and backyard. Per licensee, areas off limits to children and parents include: entire second floor, kitchen, living room, front yard and garage. The LPA toured all areas used by children during this visit. LPA observed that there is an electric fireplace in the living room which is an off limit area. The licensee provides food for children in care. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a cellphone that is used and the cellphone stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection. ------------------------------------------------------------- Pg. 1 of 4 --------------------------------------------------------------------- Detergents, cleaning compounds, medications, and other items which could pose a danger to children were not observed to be accessible to children. The licensee states that there are no poisons in the home and understands that storage areas for poisons must be locked with a key or combination lock. The restroom that children use was observed to be safe and sanitary. At 11:50 LPA observed that the valve on the required 2A10BC fire extinguisher indicates charge but was purchased on January 2020 as indicated on the receipt. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill conducted was on 3/6/2020- Licensee does not have any children in care since COVID therefore she has not been able to conduct a drill. Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted at the entrance of the facility. The home is observed to be clean and orderly. Where children less than five years old are in care, stairs are fenced or barricaded. There is a child safety gate which keeps stairs inaccessible to children. There are toys available for children. Appropriate sleeping arrangements in forms of cots. Licensee states that she is not currently caring for infants. LPA advised the licensee to sleep infants where they can always be directly supervised and advised the licensee against sleeping infants in a separate room. Licensee states that if an infant is enrolled, the infant will sleep in the day care room where they are constantly supervised. LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home. Currently, children are using the back yard for outdoor play time. LPA did observe furniture and daycare equipment that needs to be clean and organized in the outdoor yard to make back yard accessible for children. Per Licensee, she is cleaning these items to have them available when children come back. Licensee, will submit pictures to LPA when done with the yard.LPA did not observe any objects that can pose a danger to children in the outdoor yard. --------------------------------------------------- Pg. 2 of 4 ------------------------------- There are no pets on the premises. The licensee is observed to be operating within the license capacity limitations. At 12:45 PM Licensee, had to step out to do a school pick up. LPA continue report in car and waited for Licensee to come back. At 12:50 pm children’s records were reviewed, including emergency information, the files for the children that are picked up from school were observed to be complete. Licensee returned to facility at 1:22 pm- visit continued inside the home at this time. The licensee have completed training on preventive health practices including Pediatric First Aid and CPR. At 12:30 LPA observed that licensee's Pediatric First Aid and CPR expired on 6/25/2020. There are first aid supplies available. The licensee does have proof of immunization against influenza, pertussis, and measles. LPA observed that the Licensee does have proof of previous Mandated Reporter AB 1207 compliant Child Care Training Certificate with expiration date of 2/11/2020 www.mandatedreporterca.com LPA issued a Confidential Names List (LIC 811) to the licensee which documents staff and children’s files reviewed during this inspection. Incidental Medical Services (IMS) : The licensee states that she will provide IMS. Per licensee, there are no children enrolled that require IMS at this time. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following was discussed with the Licensee: Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty. In the absence of the Licensee, a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current adult/infant CPR & Pediatric First Aid certification and a valid criminal record clearance associated to the facility license. Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
