At 1:30 pm Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. A risk assessment was conducted upon entry- appropriate PPE was used. LPA met with Angelica Reyes, Licensee who guided analysts on a tour of the facility. Per Licensee, there are 13 children currently enrolled. A current children\342\200\231s roster was available for review. There were 13 children present upon arrival- 2 being infants. Also present during inspection were 2 assistants. At 1:37 pm LPA observed infant child # 1 sleeping on a booster chair with the tray on and a blanket covering the infants top body. Per Licensee child # 1 has just fallen asleep and as they were leaving soon infant was not transferred to appropriate sleeping arrangements. LPA Lopez advised that only cribs and playpens should be used for sleeping- and if infants fall asleep before being placed in crib or playpen , infant should be moved immediately to crib or playpen. Licensee, removed child from booster chair during inspection. This is an immediate risk for the health and safety of children in care. The licensee states that 3 adults and 2 children currently live in the home. Per Licensee, they currently has 2 assistants. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home. Licensee states that there are no firearms stored in the home. This is a one story home which consists of 3 bedrooms, 1 bathroom, living room, dining room-kitchen, garage, laundry room, front yard and backyard (fenced). The children have access to living room, dining room- kitchen, 2 bedrooms, 1 bathroom and backyard fenced.------- pg. 1 of 5 ------------- Per licensee, areas off limits to children and parents include, 1 bedroom, laundry room (used as walkway to backyard), front yard and garage. The LPA toured all areas used and not used by children during this visit. LPA advised licensee, that an updated facility sketch needs to be submitted to the department. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a landline and a cellphone. There is ventilation and heating (central). The following was observed and reviewed during this inspection. Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee, there is no poisons in the home. The restroom that children use was observed to be safe and sanitary. At 1:50 pm LPA observed that the required 2A 10BC fire extinguisher was last serviced on 11/05/2020, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill documented was conducted on 2/28/2023. Emergency Disaster Plan, Parent\342\200\231s Rights Poster and the Facility License were observed to be posted in the living room. The home is observed to be clean and orderly. There are toys available for children. Appropriate sleeping arrangements in form of cots and playpens were observed. Licensee states that they are currently caring for infants. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at -------------------------------------------------- pg, 2 of 5 ------------------------------------------------------------- https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. At 3:00 pm LPA observed that Child # 1 did not have the LIC 9227 Individual sleeping plan on file and that Child # 1 and # 2 did not have sleep log documentation. LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home. Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard. There are pets on the premises. LPA observed pets to be off limits The licensee is observed to be operating within the license capacity limitations. At 3:00 pm children\342\200\231s records were reviewed, including emergency information and were observed to be complete. ------------------------------------------------ pg. 3 of 5 --------------------------------------------- LPA provided the LIC 857 and LIC 859 which documents the files reviewed on this date. The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 9/2024. There are first aid supplies available. LPA observed that the Licensee and assistants do have proof of immunization record and the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file. LPA issued a copy of the LIC 857 Children\342\200\231s Records Review and the LIC859 Staff Records Review to the licensee during this inspection. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Based on the LPA\342\200\231s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety. LPA Roxana Lopez informed licensee Angelica Reyes that this report dated 4/18/2023 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Roxana Lopez informed the licensee to provide a copy of this licensing report dated 4/18/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
