What the inspector wrote

Licensing Program Analysts (LPAs) Nolan Tcheng and Mariah Aguirre conducted an unannounced Case Management inspection for the purpose of following up on an incident reported to our Department on 11/21/2024. Upon arrival at 1:50pm, LPAs met with Lead Teacher Karina Garcia, to whom the purpose of the inspection was explained. Facility is located on the campus of Baldwin Elementary School. A tour of the facility was provided. There were children present during the time of inspection. There were 3 children and 2 staff members. On 11/18/2024, a incident occurred at the facility where Child #2 pushed Child #1 while they were in the restroom. Child #1 slipped and hit their head. Further medical evaluation diagnosed a mild concussion, and was reported to the facility on 11/21/2024. Today's inspection's purpose is to determine if there was a violation of personal rights. Interviews were conducted with one staff member. LPAs observed the area of the incident. Child #1 and Child #2 were not present for interview during today's inspection. During interview, Staff #1 stated they were positioned between the restroom and snack area while children were entering. Staff states they usually check the restrooms before children enter to see if anyone else is present, if it is clean and safe, and that only a few children are sent in at one time. Staff #1 stated that two other school programs use the same restrooms. LPAs reviewed the restroom and observed the floor to be wet with water from the sink area. First aid was immediately provided to Child #1 following the injury. Staff #1 stated they continually remind children of the rules and appropriate play. LPAs observed a sign in the classroom that specifically states the restroom rules. Staff #1 says Child #2 pushed Child #1 but did not think it was hard. They do not believe Child #2 did it out of malicious intent. Based on the information above, facility staff followed through with appropriate first aid for the injury and were abiding by Title 22 regulations during the time of incident. There was nothing staff could have done to prevent the injury from taking place. No deficiencies are being cited during today's inspection. An Advisory Note is being provided to facility to address the restroom protocols. A notice of site visit was given and must remain posted for 30 days.
