Licensing Program Analyst (LPA) Alicia Mooberry conducted an unannounced random annual inspection in Spanish. LPA met with Licensee Sandra Benitez who guided LPA on a tour of the facility. Also present was licensee's assistant. There were 8 children present during today\342\200\231s inspection including 3 infants. Based on Licensee and facility roster there are currently 8 children enrolled. Individuals currently living in the home were discussed and noted. This is a two story home which consists of three bedrooms and two bathrooms. Areas used by the children include the living room, day-care room, bathroom located on the first floor, and gated sideyard. Per Licensee, areas off limits to children and parents include: three bedrooms and bathroom located on the second floor, kitchen, and front and back yard. Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. There is a working telephone maintained in the home. At 2:20pm LPA observed a can of lyson and a bottle of mouthwash on a low cabinet next to the sink in the bathroom used by children. This poses an immediate risk to the health and safety of children in care. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. The Licensee states that there are no poisons in the home. At 2:22pm while inspecting the outdoor playarea, LPA observed a gate which separates the side yard from the back yard. LPA observed an above ground pool covered with a loose fitting tarp with approximately 1 foot of water. LPA observed that the pool was empty. Licensee was advised to maintain pool empty during hours of operation. Technical Advisory given. Per Licensee, there are no weapons or firearms in the home. There are safe toys, play equipment and materials observed for children. Emergency Disaster Plan was posted at the time of inspection. Children\342\200\231s records were reviewed to ensure that each child has an Identification and Emergency form. Page 1 of 4 The valve on the required 2A 10BC fire extinguisher indicates fully charged with a service tag dated 8/2/21. Smoke and carbon monoxide detectors were tested and are in operable condition. The Licensee's assistant has current Pediatric First Aid and CPR, which will expires 09/2022. Licensee's pediatric First Aid and CPR expires 8/2021. Proof of immunization against influenza, pertussis, and measles for the Licensee and assistant was readily available during today's inspection. Licensee and her assistant have also taken the Mandated Reporter Training. The following was discussed: Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain a criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty. Rooms that are off-limits need to be made inaccessible during operating hours. The safety gate at the bottom of the stairs should always be kept closed during hours of operations. No smoking, No infant walkers, No Johnny jumpers, No saucer chairs, No trampolines and any other item that falls into that category are not permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in pediatric first aid and pediatric CPR is on site at all times when children are present. Mandatory Forms for the children\342\200\231s files and staff files, requirements for fire drills, earthquake drills and documentation were discussed Last drill was 07/2021. The Licensee was advised how to access forms and Regulations online at www.ccld.ca.gov . Licensee was made aware that it is his/her responsibility to know the regulations as well as anyone who assists in providing care. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Sudden Infant Death Syndrome (SIDS) and Never-Shake-a-Baby were discussed. Page 2 of 4 Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA observed infants sleeping in separate cribs in the living room and childcare room where they are constantly supervised. Mattresses were observed to be firm and covered with a fitted sheet. Cribs and play yards were observed to be free of loose articles and objects. LPA advised Licensee that no objects shall be hanging above or attached to the side of the crib or in the crib while infants nap. LPA did not observe any infants swaddled while in care. LPA advised the Licensee that infants shall be placed on their backs for sleeping and shall be supervised. Licensee did not have sleeping log available for LPA to review. LPA advised Licensee that infants shall be checked on every 15 minutes and the time of each 15-minute check shall be documented with child\342\200\231s name and date. The LIC 9227 Individual Infant Sleeping Plan shall be completed for each infant up to 12 months of age. A copy of the LIC 9227 was provided to Licensee. Currently, children are using the side yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard. The licensee is observed to be operating within the license capacity limitations. Licensee is currently transporting school age children. LPA reminded licensee that children should never be left in parked vehicles. Car seats shall only be used for transportation. LPA did not observe any children sleeping in car seats. LPA issued the Children's Record Review List (LIC 857) to the licensee during this visit. The deficiency listed on the following page were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809-D. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety. Page 3 of 4 Licensee and assistant were observed to be wearing face covering in accordance with Department of Public Health COVID-19 guidelines including face covering, social distancing, enhanced cleaning. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child\342\200\231s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee/Director. Exit interview was conducted with Licensee. The Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms. The Notice of Site Visit (LIC 9213) \342\200\223 must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative.
