What the inspector wrote
On 8/22/23, Licensing Program Analysts (LPAs) Alicia Mooberry and Susann Sanchez conducted a required annual inspection in Spanish. The facility is on probation status effective October 7, 2021. Upon arrival at 1:30pm LPAs met with Sandra Benitez, Licensee, and explained the purpose of the inspection. LPA provided the inspection Entrance Checklist, LIC 126. There were 8 children present including 4 infants. Children were observed napping in the daycare room. Also present was

, Assistant. All adults present have obtained the required background clearance. Per licensee the hours of operation are Monday-Friday 6:00am - 6:00pm. Individuals residing in the home were discussed and noted.
This is a two story home which consists of three bedrooms and two bathrooms. Areas used by the children include the living room, day-care room, bathroom located on the first floor, and gated sideyard.
Per Licensee, areas off limits include: Entire 2nd floor - consisting of two bedrooms and bathroom, main floor: bedroom, kitchen, front and back yard. There are safety gates making off limit areas inaccessible to children in care.
All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection:
LPA observed the facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form posted in the living room. Licensee was advised to post the required posted documentation in a location visible to parent/guardians of children in care. LPA reviewed completed facility records including; LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan.
Smoke and carbon monoxide detectors were tested and are operable. Fire extinguisher indicated fully charged and was serviced on 5/8/23, Licensee was reminded that fire extinguisher needs to be serviced yearly. The home maintains telephone service via cell phone/LAN line.

The home is observed to be clean and orderly. There are toys and other age-appropriate material available. LPAs observed that cleaning compounds are in kitchen inaccessible to children in care. The bathroom that children use is located in the hallway and observed to be clean and free of hazards.
Licensee states that there are no poisons stored in the home and understands that all poisons must be lock, not only inaccessible to children.
Per Licensee there are no firearms or weapons stored in the home. Isolation area for sick children waiting to be picked up is in the living room, supervised and away from the other children.
Licensee has 4 infants enrolled. LPAs discussed the safe sleep regulations with licensee in Spanish and discussed the Child Care Licensing Safe Sleep webpage

as an additional resource. LPA Mooberry also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at

and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
Currently, children are using the sideyard for outdoor play. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to freely use. LPAs observed a large bird enclosure the is not accessible to children in care. There were no objects observed that could be hazardous to children in care. The facility does not have a pool or similar bodies of water.
Children\342\200\231s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights, and documentation of 15-minute Infant Sleep Check (0-24 months)
Staff records were reviewed for approved Pediatric First Aid and CPR certification, LIC-501: Personnel Record, LIC 508-Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunizations against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate.

LPA Mooberry discussed with licensee current COVID-19 recommendations, precautions and procedures.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
Based on the LPA's observations and records review no deficiencies will be cited today in accordance with California Title 22 Regulations.
During the exit interview, Sandra Benitez, Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
